LAW AND COLLECTIONS
LAWRENCEBURC, KY‘

October 7, 1913.

Miss Laura h. Clay,
Richmond, xx
Ky.,
My Dear Miss Ciayzm

I have the honor to report that on Wednesday, October 1,
we ha& a hearing before Circuit Judge C. C. Marshall an my mac
tion for a writ of mandamus against our County Clerk comfieliing
him to ya prepare separate ballots for the use 9f women voters
in the next election, and on Friday the 3rd,, we gained a Game
plate vietery in the decision. Ehe Court sustained me in every
point raieed in the argument, holding that women poeeeeeing
the statutory qualifieatione were entitled to vete for all
school efficers, and that the Uounty Superintendent is a school
district officer within the meaning of Chapter 47, of the Acts
of 1912. The writ of mandamus was issued and, on the following
day,was served on the County Clerk. The County Attorney, who
is bitterly OPPOSed to the suffrage cause, conceived that it u
was his duty to defend the suit, and filed a demurrer to the
petition, which wee overswuied by the Ccurt, anfi he will carry
the case at once to the Court of Appeals on a motion to dis«
charge the writ. However, i am confident that he will be overe
ruled there as he was in the Court below. i am confirmed in

this opinion by the statement of Judge Marshall in rendering

his opinion in deciding our 0356, He said that personally, and

as a matter of principle he was opposed to the idea of women

0n any question, but that the Legislature had the right to enact
the lad and had made it no plain that he wag compelled tc issue
the writ and to hold than as 1 have already stated. The @485a
tinn being presen ed far the first time in this district, txere
was a large number of lawyers present at the argument, and
among them some of the most able men in the profession in

Central Kentucky, and the: all said that the Judge was correct

in his ruling, and that the Court of Appealn would undaubtedly

sustain kin opinion. The decision was so convincing that I an
not believe the case would be taken up further, but for the
request of Judge Marshall that it be done so that it coulfi
be decided once for the whole state, and it is certain an
to g0 to the higher court.
I should be glad to hear from you as soon as possible with

any suggestions you may have to make.

Very truly yours ,

My dear Miss Clay:

While on the train going to and from Washington I
made ten tattin jabots and censecrated them to our suffrage
leaders whom I dearly love.I do not have to watch my work very
closely so could vgiew the landscape over as I tatted.

With loVe and Christmas greetingsL p
