INSTRUCTIONS.

1. Who is required to make a return.—Every domestic and foreign corporation, joint stock company or association, or insurance company with a taxable net
income which is required to file a return of net income under the Act of September X, 1016, as amended by the Act of October 3, 1917, is required to file a return of
undistributcd net income with the collector of internal revenue for the district in which the return of animal net income is filed.

2. Time of filing return—The return of undistributed net income must be filed within 60 days after the expiration of six months from the close of the last
taxable year (that is, the calendar year, or fiscal year if difierent from the calendar year).

3. Income subject to tax.—’l‘he net income of the last calendar or fiscal year remainingr undistributcd six months after the end of such year, which is not
actually invested in the business, nor retained for employment in the reasonable requirements thereof, nor invested in obligations of the United States issued after
September 1, 1017, is subject to a tax at the rate of 10 per cent.

4. Compulation of tax for fiscal year, part of which falls in the calendar year 1916.——If the fiscal year for which this return is made ended during the
calendar year 1017, the tax will be assessed on that portion of the taxable undistributed net income returned for the fiscal year which the period between January 1,
1917, and the end of such fiscal year bears to the whole of such fiscal year.

5. Application of tax at rate of. 15 per cent.-—lf any portion of the net income of the taxable year reported to be retained for employment in the reasonable
requirements of the business shall not be so employed, a tax of 15 per cent will be collected thereon.

6. Time of paying tam—The amount of tax assessed on the undistributed net income of the taxable year is payable to the collector of internal revenue within
10 days after the day of notice and demand of tax assessed. If the tax is not paid within that time a penalty of 5 per cent of the amount thereof, plus 1 per cent interest
per month that the tax remains unpaid, will be imposed.

_ 7. Other penalties—Any corporation, joint stock company or association, or insurance company, refusing or neglecting to file a return within the time pre-
scribed by law, or making a false or fraudulent return, shall be liable to a penalty of not more than $10,000, and an amount equal to 50 per cent of the amount due
shall be added to the assessment in case of neglect to file the return within the time prescribed by law, provided that in case of delinquency if the return is volun-
tarily filed without notice from the collector and it is shown that the delay in filing was due to a reasonable cause and not to willful neglect, the amount of 50 per
cent will not be added to the assessment. Any officer of wy corporation required by law to make, render, sign, or verify any return, who makes any false or fraud-
ulent return or statement with intent to defeat or evade the assessment required to be made, shall be guilty of a misdemeanor and Shall be fined not exceeding
$52,000 or be imprisoned not exceeding one year, or both, at the discretion of the court, with the costs of prosecution. 2—451".
