citizen of Floyd County, Kentucky, and resides at Dealsa Kenek
tuokyn .

Thet on the 11th dog of Jennery, 1917, this 91 intiff

‘ bought from the agent of the scienaantg at its ticket office
at Cntletieburga Kentucky, one ticket entitling him to one
first class passage from Cotlettsourg, Lentucky, to finale,
Kentuekv. That with said ticket in his possession he boarded
the defendants oessenger train leaving o tleftshurg, Kentucky,
at about 4:15 P: i. of the same day. And thereafter, as the
train proceeded on its run from fiatleitsburg, Kentucky, through
the counties of Boyd, Lawrence, Johnson and Floyd, to Duels,
Kentucky, this plaintiff upon deufind from taefionauctor of
said train, duly surrendered to him his tickete 2

The gleintiff states that while he was a gessenger on said
train and entitled to free and unmolested transgortation and
passage from the city of Hetlsttsturg, Kentucky, to'nis home at
D3319, Kentucky, and after said train had pulled out of Exes“
tonsburg ststiou on its toy towards finale, kentucky, at a pOint
somewhere between Trestonsourq and Bwale, one lee neuhom, Clank
ing to be e fipefiioi u?fiaor one omgloyee of tee defendant,
Chesapeeke & Ohio Railway flomyuny, assisting said flonduotoz in
the m nogenent and Opefififiifin of said train, and while so acting
as such employee and syeoigl officer of the oefendent, and in
the eisonrrgs of his Euties as such, ohms upon this plaintiff
where he was 3 passenger and quietly occupying a set in one of
said cars and unlawfully and wrongfully assaulted him and laid
Violent hnnde upon this plaintiff and jerked him free his seat
into ffi? visle; grebhed field of min person in.the presence of a
large number of persons, searched his Llothing one yockets, sc-
eused him of carrying s concealed sesdly weapon en: thus humil-
iated, insulted, embarrassed and greatly frightened this plain-
tiff, causing him great mental anguish and gutting him in imme—

Plaintiff states that at the time woen the said Lee Lennon
as en employee of the defendant, Chesapeake and Chic Railway
Company, took hold of and assaulted him, as hereinbefore a1»
leged, he was peeoable and orderly occupying nis seat; was sober
and well behaved, and gave no occasion wasteVer for such assault
and that when he was jerked from sis seat the said employee of
the defendant, Chesapeake’end Chic Railway Company, jerked himu .
so violently and quickly that it gave him great pain in his left
arm and shoulder and rendered it sore and painful, from which
he sufferred thereafter greet physical pain.

That the said wrongfuly sets of the said Lauhon as here-
inbefore complained of, was done in the presence of a large
number of persons, passengers on said coach, and that while .
this plaintiff was being thus wrongfully handled and searched

. and accused of carrying a deadly weapon, as herein alleged, that j
j a large number of aaidpeople were gazing and looking at this

 plaintiff, thug humiliating and greatly embarrassing him, from
which he guffarrea great mortifie9t13n of ieeling and great fear
of physical injury at the hands of the said Lee Iauhon, vho then
appeared mgae vialefit and reakless, all to his great damage in
hereinbefore alleged.

WHEREEORE plaintiff prays Judgment againsfi the defendant
for the sum of 3 100$.C§ in damages” and for all proper relief,
and of tais he dagands a Jury.

In service two and onemhalf years
Mr. Duke you were Brekeman of train No. 58 January klth, 1917
when a passenger by the name of James Dsmrcn claims he was going
from Catlettsburg to Dwale and near Prestonsburg on this date Lee
Lauhon, Special Agehtm assaulted him and jerked him frgm his seat
into the isle and searched him, accusing him of carrying a concealed -
weapon. Please state what you know about this. 7
V Yes sir I was Breheman of No. 58 this date,
On date in Question we had trouble with three or four drunken
men in the rear coach and these men had to be arrested. I came
through second day coach and saw a man by name of Wolford and Damron
sitting in seat together. Wolford was pulling whiskey out of his
pocket and holding it in his hand. both men were very much intoxi— .
ceted. I went to this man Wolford and told him to put hp his f
whiskey or give it to me. He swore and and no dam man would take
his whiskey. This fellow Hamron spoke up and said you cannot take
mine either. About this time Lauhon stepped up behind me and when
he saw these men with the whiskey he took it and handed it to me ,
and searched Wolford and then Damron. Not find any weapons on these
men he let them sit down and gave them their whiskey back and told
them to put it away.
Were these men.sseeulted in any way? =
No sir, Mr, Lennon did not do anything other than what I would
consider the performance of his duties as an officer.
A. Where was ydur Uonductor?
Conductor Watkins was in charge of the train, but do not know
where he was. ‘
Why did Mr. Leuhon search these men?
On account of having trouble in rear car and arresting some
men someone on train told Lauhon these men were going to cut him
in-two for arresting these other men and when he heard this he
_ immediately went to head day coach and when he found these men with
whiskey and neing boisterous language he searched them to be on the
safe side, but did not find anything on them“
