I have your brief and the record you had in the Damron
case. MT. Moores brief and the bill of evidence is in the clerks
office and.we will get it today and write *our brief tomorrow and
then the case will go out to the court.

I have read your brief with care and it really covers,
all the points, and covers them well, that could be made in the case,
so that our brief will be nothing more than a restatement of what
you haVe said.

There is really nothing in the point that Moore raises
that so much of the act as declares that the next highest man shall
get the office is void, at least this is my best judgment about it.
There is ample evidence in the record to create the strongest kind
of suspicion as well as reasonable inference that Johnson did use
money and plenty of it, but we are confronted with our failure to
show his direct connection with any money except that given by him to-
Ratliffe. It would really be a fine thing for pure elections if the
court would hold that the evidence we have is 2 sufficient and I
hope they will.

The first trial was oowrenoad on the 5th day of Sefitembwr,

will think strange of this, and in fact we cannot conceive
of a mare astonishing excuse to be offered in any comrt.
Judge Vanover was absent when the nonice or
aontest was filed in the circuit court clara's office,
holding court in Letaher County. and'did not return to
rikcville unuil about the 33th of August, or some days
after the fiVa day limit had expired and no other Judge
was preuent to hear the content.

Before proceeding to discuss the evidence of
the various witnesses we shall iuvite tho COUiL’B atten-
tion for a MOMGHL to the feet that appelleo received 5834
votes, ugpellunt 1E79 votes, and one i. E. Aesthloy 151
votes, or a clear majority in favor of sypcllee oi 4555
votes. The notice of contest is vague and very oamoral.
It simply charges that appellee ooutributed to a large
corruption fund and thus violated the provisions of the
Corrupt Practices Act. But in the face of the above
result it would be hard to c0ncoive of the necessity of
. appellee or any other person being guilty of doing the‘
