4th. To deliver to first yarty in pipe lines frae of
Charge one thenth of all the oil they may produce and save
from gala lanfi.
5th. To pay first party for any well from which gas 13
marketed semi-annually in advance of the sum of One Hundrefi
Dollars at the beginning of each Six months while the sale of
gas continues.
66h. To pay any money becoming dué to first party at
Pikeville in said County.

about $150,000 with a View and for the purpose of finding oil

under and by virtue of the authority granted to it by the

record an instrument of writing surrendering each and all of
said leases. ‘

V That a large number of the persons to whom said
surrender was mane are falsely giving out in speech and
claiming that rental for the years 1895, 1896 and 189? was due
them on their reapective leases, which is not true; and many

instituted suite at law against this Plaintiff in the Fake
Circuit and Pike Quarterly Courts in the State of Kentucky;
and Various other of the loggers, the name and number of whom
are at present unknown to this Plaintiff, ere threatening to
institute suite for three or more years rent alleged to be
due them. That the said defendants who have instituted
‘ suits and those who are threatening to institute suits are
involving, exposing end about to involve this Plaintiff in.
. numerous and vexatioue emits at law, when the questions at
issue uni involved in each suit are precisely the same and
