Mr. James Hatcher of Pikeville, Judge York, A. K. Hatcber
and Sam Hereford, as we are advised, perhaps in connection ,i’k others,
are doing us quite a good deal of damage in the Beaver territory by
persuading people to refuse to execute deeds to us pursuant to contracts,
and, as we are further advised, are spreading all kinds of reports as
to why it should not he done, putting false constructions uyon our
deeds and asserting that ye are afraid to sue flew, and pursuing such
tactics as you can very well see would be done ‘y a class of men en-
gaged in that kind of business.

This will he handed to you by our Jr. A. L. Martin and D.J.
Chandler, who will explain to you what services we now desire you to
do for us.

Elst? and I replied as follows: "Mr. Harvey South returning about
Tucsday.Wilson away also." I would appreciate if you would drop me
a line stating just how the different suits stand and whether the delay
will interfere in any way with our holdings.

Bement and Wilson tracts, thefi were sold for taxes, recorded and submit
copies of letters from E. H. Cornett, Sheriff of Perry County dated
January 15th and 30th and also copy of the County Clerk's record and
would like to know if they are legally correct and if aoything else
should be done in the matter. The receipts that R. F. Fields (the
party who purchased the land) forwarded me are the formal receipts
from the Sheriff in the names of W. P. Wilson and W. P. Bement for
their respective amounts and his individual receipts f0; cost and
damages. I would state that theoe have not been recorded and would
ask if it is necessary now to have it done.When may T expect Housficn deed?

‘ I have just returned from a trip to Cincinnati and
Chicago and I find yours of the 18th. ultimo. at hand. I am a
little bit surprised that you have not already the information
requested, after having made two trips to your office to give you
all necessary information. However, I will give you the desired
information, and when you have read the explanation you will see
that everything is regular.

Tract No. 1 platted out 195.71 acres. Out of this I have
deducted the 13.75 acres claimed by H. J. Moore, leaving net
181.96 acres. The H. J. Moore tract contains 15.75 acres instead
of 18.75 acres. I enclose the original notes from nhichxyou can

. see for yourself the number of acres. This leaves in the whole

‘ tract 170.64 acres, in fee, and 11.32 acres of coal for which I '
claim pay for. In my dead to Mr. Langhorne I exclude entirely the
above H. J. Moore tract because Mr. Moore refused to compromise
except on payment to him of $4.00 per acre.

Tract No. 2: The Smith Mullins' 50 acres junior patent
surveyed out as at ted 64.34 acres. This, to—gether with the 26.95
acres and the 11.11 acres spoken of by you as being in Tract Ho. 2,
was conveyed by J. M. Roberson and others to said Smith Mullins
reserving the cod. and other minerals and rights of ray as in all
the other deeds. This deed I did not have with me when I was at '

your office. It is on record in Dead Book No. 55, page 61 of
the recordsm of this County. Also a deed for the 10.56 acres of
William Bumgardner, referred to by you, is of record in Deed Book
No. 55, page 115. This tract we purchased outright from Mr.
Bwngardnsr andiicok an absolute deed for it from him. This deed ;
I did not have with me when I was at your office. I enclose a
cerfificate from the Clerk of the Pike County Court showing that
the deed to Smith Mullins and the dead from William Bumgardner
is of record as stated above.

F. M. Mullins, for whom we returned a deed for 45. 46 acres,
is purely a squatber.

The King Ahers’ patent is a junior patent, and was sold to
Lovi Greer by King Akcrs, and by Greer to Nancy Tackett, but no
dead was made to Nancy Tackctb, the legal title still remaining
in Levi Greer. Last Summer, while the land was being surveyed,
Nancy Tachett sold the land back to Greer, and he being the owner

‘ of the land we mado terms with him.

I have now given you alli the information requested. My
deed to Mr. Longhorns is in accordance with the facts set out
herein. Everything is regular. The dead has been ready for deliv—
ery since tho 24th. of November, 1902. Could you give me any
information as to when I may expect payment for this land, as I
have been at considerable expense and am needing the money very
badly. The decd to Mr. Longhorns has been acknowledged by my wife
and myself and is ready for delivery.

Your recent favor came duly to hand and the package con-
taining samples of fire clay was delivered to me by the Alger
House people of Catlettsburg, Ky,, and from what I can see it
appears to be very excellent, but I am not familiar with this ma-
terial and have been waiting to confer with some friends of mine
upon the subject of fire clay, but have not yet been able to see
them° It is apparent to my mind that a large quantity of fire
brick will be needed in this district for lining coke ovens and
my idea was to call their attention to this product and will do
so when I can see them. I should have replied to this latter
sooner, but have had so many things to do that I could not get
around to it. I hope that you and your family are well.

Yours of the 21 inst. came to hand last night and I
note what you say regarding the pégent for tracts Nos. 2, 3 a 4.
It is not at all satisfactory to me to take payment for the three
tracts mentioned/and leave off No l. The title to No 1 is just as
good as the other three and, to my mind, there is no reason why I
should not have payment for all or none. I explained inflmy last let—
ter to you very fully the condition of tract 1. I wrotéAthere were
15 3/4 acres in the possession of H. J. Hoore which I could not get.
Mr, Moore had contracted all of his coal and mineral to Mayo last
spring. Itried to make terms with him but could notmggeany satisfac—
tory arrangements. Mr. Moore, so I was in formed by good people,
and those under whom he claimed,had had this small piece of land
in adverse possession for more than 20 years and, of course, would
hold it by adverse pssession. Therefore, in order to make my title
clear, I employed W. J. Roberts, our county surveyor to survey the
small piece in Moore's possession.He did sofand it platted out 13 5/4
acres. Now, under these circumstances, you know as well as I do that
I cannot make a good title to this little piece ofi‘land. The title
to the remainder of the larger tract is good. The whole area of tract
No l is 195.71 acres. From this I deducted the 13 3/4 acres, leaving
a net acreage of 181.96 acres. This number of acres I convey in my
ia—my deed to Mr. Langhorne and exclude from the operation of the
deed entirely the 13_3/4 acres. This is all I possibly can do if we

were to wait ten years. The title on my part cannot be perfected any
better than this. John A. Mullins had on the upper end of tract No l
in his possession 11.32 acres.We made deeds to each other, he Keep—
ing the surface and us the coal and.ndneral. So that we have 11.52
acres of coal in tract No l leaving anet acreage of 170.64 acres in
fee. This I convey to ur. Langhorne in my deed and no more,and to

I will now again state the number of acres, fee and coal, in each
of the four tracts.

The number of acres in fee, at $9. per acre, amounts to $4075.0Sf
and the coal at $4.50 per acre amounts to $885.65. Making a total of
$4960.65. Mr. Langhorne has paid me the sum, all told, of $1361.82'
leaving due me on the four tracts the sum of $5598.81. Now, if Mr.
Langhorne, or if you as his attorneyfi and agent, want to settle with
me on this basis I will be pleased to do so. If you do not, let me
know by Tuesday nights mail. Iwill then come to Prestonsburg and ten—
der to you as the attorney and agent of hr. Langhorne my deed convey—
ing to him my undivided one half of the four tracts with general war—
ranty, in accordance to the contract between us. If you refuse to

Last winter Mré Langhornc asked me to pay apart of the expenses
of sunvaying the land and I told him that Iwould pay $150. This was
not satisfactory to him,‘nbut wanécgfins to pay something like $240.
Ircfused to pay that much and tgcsgdcd without any agreement on this
particulai‘ matter. I suppose, however, he will contend that I. agreed
to pay this amount on the expenses of surveying: land. I now say there.
was no agreement made as to this matter, and I now refuse to pay
any expenses. Ihave had my deed ready to deliver to Mr. Langhornc
ever since about the 20 of Nov. last, and have been kept out of the
use of my money four or five months, and for this reason decline to
pay any expenses. If you desire any further in formation, call me
up over the phone and I will be pleased to give it to you. If I do
not hear from you by Tuesday night, I will then come to Prestonsburg
the first Opportunity and presnt to you for Langhornc my dead.
