I hold the note of Mrs. N. B. D. May for $2133.75,
dated on the 16th day of December, 1905, and payable
two years after its date, with interest from its date.
This nore was executed to Henry & Graham, as you remember,
for our fee in the suit contesting the will of the late
Colonel A. J. May, and for expenditures made by us in
that caSe, and the note was transferred to me by the
firm.

Mrs. May paid some interest on this note about a
fear ago. I am not sure whether she paid one years
interest or two years interest; the check which she sent
me will show.

I am very much in need of this money, and I have
written to Mrs. hey several times recently, asking her

_ to pay it, but she pays no attention whatever to my let—
ters. I therefore take the liberty of writing to you
and asking that you will call her attention to it, as you
are her counsel and kinsman.

I repeat, that I would not be urgent about this mat—
ter if I was not greatly pressed for money. I have some
engagements to meet at once, and I cannot meet them unless

Since our conversation over the 'phonc this morning
I have carefully examined the leases on the Tipton Hall Tract,
and am not so sure that we have been in possession of all of this
tract through our tenants, and this fact may change the nature of
the action that is to be brought against Erasure. I ac sending you
herewith a copy of the last loose to Andy Martin for 1he year 1008,
which speaks for itself and seems to bear out the fact that a part
of the land was then in the possession of some other party, precur—
ubly Frasure. I hevcn't any more blanks upon which to make copies
of the contract, but have ordered them from Aehland 5nd Til“ Fond
you copies of the other three within R day or two.

Our first lease war to Tipton Hall on a regular blank
form, and was dated October 8, 1905, the date of the deed to us,
and ran up to and including January 1, 1906, with the following
provision in the contract: "And the party of the second part
hereby agrees to pay all taxes assessed against said property for
the year 1904. Second party may surrender possession January 1,
1905, but in that event said second party is to be paid whatever
rants that are realized from said land during the your 1905 "

It is my recollection that Iipton Hall remained upon the land
himself part of 1he time, and afternards sub—leased it anfi moved
to a farm on Tellers Creek. I also have an impression that there
was some kind of a collusion between Tipton Hall and Erasure, by
which Frasure got possession of part of this tract before Tipton‘s
lease expired. I an not certain as to this, but it seems to be
borne out by a provision that is in the next lease, which is dated
December 31, 1905 and ran until December 51, 1906, to John Hall,
lorg‘s son, which is on a regular printed blank with this provision
written in: " decond party has the right to sub~lease this tract.
9arty of the first part binds itself to refund any money occasioned
by the loss of any suit broueht by Robert Frasure for this tract of
land during the year 1906." The land was leased to Andrew
Hartin on December 71, 1906, up to December 31, 1907, on regular
printed blank, and has the following clause written in: " Second
party has the right to cut timber to cover the dwelling house on the
above described tract. but all timber must be used for the use 0? {he
said tract. The second party is to cut, split and lap up 1000 rails
and *0 have 010.00 for the work."
I am sending you a cepy of the contract for the year 1908.
There may be some other facts that I am not familiar with fibich would
it .
change the nature of the action, but which would seen from reading
this coniract that Frasure had been in possession of part of the
tract (the Dry Branch part) since the latter part of 1905.

I suspect you had better take the time and be sure as to
your possession before filing the suit. I Till call Hr. Vaughan's
attention to the matter the first time he comes to Pikeville,
and if there is anything you want him to find out and report
for you, please let me know so that it can be attented to at
once.

I have seen Mr. Collinsworth and also Mr. Bunyan.

Cillinsworth says no settlement has been made with him for the trees, says
he has not seen Mr. Lowe about the matter and nothing whatever has been paid
to him.

He says his warranty Deed from Lowe for all the trees is on file at the Court
House in Pikeville where anyone can see it.

He and Mr. Bunyan both say they will be on hand the next time the trial
comes up. Now What is the best thing to do in the matter? Please advise and
very much oblige. ‘

The affiant, Mien Spradlin, says that on the 29 day of March,
1909, he counted the nunber of logs remaining unhauled on the
tract of land, the timber on which was purchemed by Walter 9. Mar—
kins from Lafayette Thompson, which timber was cut by this affi—
ant Vor the said Walter S. Harkins; and that on said date there
was on said land above the cliff 125 good logs, and 165 good logs
below the cliff, remaining unhauled. I made this count at the
requeet of Walter S. HarKins, who stated to me that the haulers
had reported to him that they had hauled and delivered all of the
timber above said cliff on said land that was fit to make lumber.

Dear Sir:

I have yours of the 24th ultimo in re Northern
coal & Coke Company v. Elizabeth.Ratliff &c, enclosing copy

. of judgment decreeing specific performance entered at the

February Term, 1909, Floyd Circuit Court.

Instead of sending check for the amount, to-wit:$480.50
as requested by the Master Commissioner in letter received from
him, you are authorized to draw draft upon us for that annunt,
upon preparation, execution and approval of deed, and you may
say to the Master Commissioner that the draft will be honored.
I assume this will be satisfactory to him.

I note that the judgment does not give crédit for the
910.00 shown by the contract to haye been pafl, and which was
in fact paid; but I would prefer not to complicate the matter
by undertaking to correct it, and the draft may be for the
whole amount.

' You may also include in the draft, all costs taxable
against the plaintiff up to and including the execution and
approval of the deed, paying the same to the officers entitled
thereto, sending us proper vouchers. We may have paid some
of the costs heretofore, and if so, deduct the same from the
amo un t.

Please have the Commissioner to be careful in executing

conveyed, and also in respect to the boundary of laid.
I suggest that the deed be prepared now and sent to J.J.John-
son, Pikeville, for examination and returned by him to you be-
fore the next term of court. This might save errors and at
any rate would assure the preparation of the papers in time
for action by the court.

As our records show, David Conley, who executed the
contract to us, died, leaving two sets of children, each claim!
ing to be his legitimate heirs, and, therefore, the owners of
the property and consequently entitled to the proceeds; that
one Seymour Sturgill filed his petition seeking to be, and
was, made partyiupon his claim that he was the owner of an in-

. terest in the land; that he did not controvert the right to
specific performance, but set up claim to part of the pro—

ceeds. The case was, therefore, put in the attitude of

the actual owners of the land andclaimants thereof, all being
parties to the suit, not contesting the right to decree of
specific performance, but setting up clahm to the money.
If that is correct, I assume the case will remain on the
docket after the execution of the deed to us, so that the
court can adjudge as to their respective rights; and in that
event, in order that the northern should not be further liable
for costs, the Northern should be dismissed from the proceed-
ing at the ttne of execution of the deed to it, and the case

I Our reports show the service of process ends in June,1906,
at which time there were several of the defendants not before
the court. I note that your judgment recites that all the
parties were served with process, and assume that that is cor-
rect, and that guardian ad litem was appointed for the infant
defendants in accordance with the prov's ions of the Code, and
report made by him. '

In view of recent decisions of the Court of Appeals re-
quiring strict adherence to the provisions of the Code when
title is undertaken to be abstracted from infant defendants,

I would then}: you to be very careful along this ground, and
see that everything is regular, as we do not want to pay for
the land and find out afterWards that we do not own it.

'the return of the service upon process should likewise be
entered upon the docket, which I would thank you to have done.

force who can testify as to conditions pertaining to thesection of
the road at and near the west end of the Preetonsburg bridge, par-
ticularly as to the slides of earth anfi rock and trees falling from
the hills on to the track, during the past winter. We will want
these men to testify to these facts before the Railroad Commission
upon the question of a flag stop at the end oi‘thc bridge; and as
this meeting will probably be held here either the 2 or 3 of June
it is important that you give us this infomnation at the earliest
possible date.
