I have your letter of March lst, and I agree with
you that bankruptcy would probably be advisable. However, I
am satisfied that if we joined in the bankruptcy suit at the j
present time it might be held as a waiver of our security.
It would be possible for us to join as a petitioning creditor
if the Floyd County Court has not yet made its entry setting
aside the sale of this machinery to Henry Bentley, as in that
case the Goodman Manufacturing Company could aver that it held
security to the extent of $250.00, the purchase price of the
machinery upon which it held a lien,and was unsecured for the
remainder and simply unite as a petitioner for the unsecured
portion of the claim.
If you and Mr. Combs could arrange to have that -;
entry sustain the purchase of the machinery, the Goodman .
Manufacturing Company would unite immediately and we will file
the petition from this office, as you suggest, and will pre—
sent to the Court the question of appointing whomsoever you
' desire as receiver. - 1
Judge Cochran can be reached probably a great deal '55
easier from Cincinnati than from Prestonburg, and this would 7:
furnish an effective way of getting quick and final settlement
