I 5111 attaching hereto copy of snort report covering one item
of the cl Him which is for one bundle rope covered by Catlst‘tsburg, Ky. to t'reastonso-
burg, Ky. waybill 585 Jan. 3131'. MIT. I am also sending you part copy of
the above waybill.

The One other item on whi ch account suit is filed is in the nature
of fifteen belles chain clogs covered by Ironton, O to Prestonsburg, Ky. waybill.
166 October llth 1916. I am seniing herewith copy of this '.veybill which
alsc covers 24 bunile chain {logs consigned to T.i.i.Hereford-- Through rm error
the entire of both shipments were delivered to I". M. Hereford of this place. At
the time the error was discovered, my Freight Clerk J.F°Ws:"le went with Uri tier
to Bar. H+v~reford's place, but he was not be be found then and as the main "logs
were locked up they could not be secu' ed for Cri tier. However, Cri cler said he
wculi wait for lir .Hersford to came in and-l get the chain dogs , but this
he fai lei to do and returned home without them. Later he filed this suit.

I have conferred with Mr. Hereford and he is willing to pay the full
price of the chain dogs to Grider, crturn than: over to him and pay the anount
he claims as due him for the trip etc. I am in a position to advise that this
will be done; in fact I can guarantee that the company will not lose anything
an account of this item of the claim.

* If I can be of further sevvi c9 , kindly sivi se me. I am just
advised by tir. Hereford that he is making a trip tc see Crider to adjust the matter
shout the chain dogs.

In any case I will see that Mr. Hereford is on hand for this tri 5:1
and that he assumes the claim fzr the chain dogs in case the matter is not
settled before that time.

Dear Sir:

I have your letter of the 12th inst, relative to
progress of matters pertaining to the Camp Branch proposi-
tion.

' I am not able to give you any information, at this

writing, as to just when something definite may be expected.

I do know, however, that the Cunningham interests have aban-
doned consideration thereof, but the matter has been placed
before two other separate and distinct parties, with all

data pertaining thereto, while a third has been apprised of
the availability thereof and this party was to meet me some-
time this week to go over the situation with me. This latter
party knows where the particular land is and about the coals
in general, having been through that country numbers of times.

The fact that this property has remained untouched
for so long, and lying between territory now under develop-
ment ~ from a little above Prestonsburg, on the North and
a little below Keyser, on the South - is a circumstance that
must be met in trying to interest parties from a simple presen-
tation of the situation. I feel, however, that if folks could
be induced to go upon the ground and become convinced of the
existence of the various seams that have been opened, any
doubt as to the value of these coals could be overcome. From
word received from Mr. Lundy about a week ago, he advised me
that the lower property was being considered by some Pike—
ville parties. If this boundary, even, were taken-up, it would
tend to stimulate interest for any other territory adjacent,
affecting, of course, the upper, or Camp Branch boundary.

Every effort is being put forth to bring this matter
to an issue and I well appreciate the reason you have for want-
ing the Burns deal consummated, for mr. Lundy has said that

with enclosures. We are glad that you are uniting with
Judge Brown in the effort to secure the injunction. We
have just sent to the Clerk of the Franklin Circuit Court
your answer. The motion f o ra.temporary injunction will
be heard at Paris Wednesday at 10:00 o'clock. It was
poetpnned from yesterday. Will be glad if you will be
present.

We do not know just where he is and doubt whether he will
recall the Contaits of the agreement. We have had a search
made for the original in the Auditor‘s Office and have an
affidavit that it can't be found. We have also had Judge
Brown to make an affidavit as to his recollectibn of the
contents. We enclose you copy of his affidavit. Would be
glad if you would make a Similar affidavit and send to us
for use next Wednesday.

We also note your suggestion of the statute of
ltnitation. We are not certain as to which statute you
refer to unless it be section 4021a Carroll, known as the
Act of 1912.

If you cannot be present at the hearing will be
glad to have you write us a little brief on the subject
of the application of the statute to Which you refer.

Church and that this Committee has just about
completed arrangements for a loan, which would
take care of all their outstanding indebtedness.

I have yours of April 14th inquiring about the property
and assets of the Louisa Coal Company. I assume that you mean
the Eastern Kentucky Coal Company. The last named Company acquired
all the property and assets of the old Louisa Ceal Company.
In View of the outstanding optionaon this property, we
cannot quote you anything as to the property as a whole and of course
would not care to qdote you any price: on less than the whole of the
property, including its machinery etc. Inquiries concerning the
property have been quite active of late and we hope we shall be able
to sell the entire property and that it will be operated as a going
concern.
The property of the Louisa Chemical Company, which is ad-
jacent to the Coal Company's property and purchased its power there.
from, was to have been sold today at Louisa. If this was purchased
by the proper parties it may have a bearing upon future developments
of the Coal Company's property.
The writer remembers distinctly meeting you at Ashland and
hopes that we may be in a position to do business with you.
