In reply to the inquiries made through _
you by Rr. 0. 3. Hitcuell, Huntington, ?eet Ve.. ‘
Box 1345, please be advised in.anawer to hie several .
- inquiries, many of whicn can be intelligently answered ' . '
in a group.
The coal in, on and underlying the \
properties, that 1 wave for lease consists of tnree or 4
more workable veins, and eecn one of tnese veine are
at different altitudes in tee aill and of different
quality of coal. Tne first in number one, a general
purgose coal, 38 to 42 ;uchee tniak. 1 mean tnet it ‘
goints on the outcroy 35 inches and tnickens as we
drive back in the hill to 4? inches, and some inetences
. 45 inches. This coal is a general purpose coal, low
in sulphur, 102 in nun, high in fixed carbon and
14,373 heat units.
‘ The next vein pf coal is 235 feet abave
tnie and 13 coal very similar to dinnifreé on tee Kenawha '
and Border Land coal on the'Tug, 4+ to 5 feet tuiek,
with a smell parting two to three inches. ' ’
' Still agave tnie coal is another *g‘m four .
' feet thiek, coking coal. Sometimes this-is called ._
by—preduct Gael and is tee kind cf eoel that is used
in semet solvay planta. All of these veins are being
mined at different localities in the vicinity of this _
land. Very amen woulfi depend upon what size oyeretion “
your friend's clients would want to install. Tnat la, ’ f
whether they would want to lease two hundred acree, "
five hundred or two thumeend Acres. Py viewnoint is \ !
that far every tract of five hundred acres. there ought 9
to be a coal operation. Our customary terms 13 ten , ’
cents per ton and no minimum royalty for the first year, . .5
but on the second year a minimum royalty will be required ,; ,
answering to three dollaes an acre; the year follewing, , "}
\ .

a minimum royalty answering to four ddllars an acre,
and thereafter at five dollars an acre. ' éasuming _'
taat your friend will know and underatana what is ‘T
meant by this, I will not take the time to writfi, or _
impose upon him tne task of reading, an exglanfitzan as '
to minimum royalty. f
. The rear nf these different veins differs _ "
somewhat. The coking coal vein D88 a slate roaf .
. in some places and sandatcne roof in others. . Tag ,
other veina have sandstone roofs. 1 am not familiar ;
with the gealogioal enumeration of the different veina, .
Lut all of the veins £re first claca general'wurpnse
. coal, and the by-groduct vein is good not only for a
general purpoae use but for manufacturing coke. ' East ,
' all of these land} that I have to offer for leaae are T
»within two or three miles of some establisnea operation. K.
Just wnere I would locate this inquiry would depend upon )
the sire of the Company that is to be formea to oyerate _
it. In other words, if it was a fifty thnusand dollar ‘
coryoration, 1 would be wilting t0 leaae five uundrad :
acres and that would we in one place, whereas, if it , V
was & two hundred and fifty thousand dollar coryoration, . ‘"
I eculd afford to lease taem a tract of two-timuaund acres, 5
no you will see that very much depends upon_tna aituation
on fine other aidn.

This coal is goma of it right on tne railroad ‘
and acme of the tracts are across the river from which
by either employing conveyors or bridge to be used with
- \ electric haulage for bank cars makeg it posaibie to

With respect to the fiubject of giving an .

a9 doubtless the lessee would be glad to secure the

Dear Sir: ‘,

Yours received, relative to the coal lands we own. I
We have a large concern to look over the property this coming week, »
but will be shed to have you or whoever you have in mind to look
over the property. . .

I hevn‘t any annalysis of the coal,at this time; find a por—
tion of it cost me $50. per acre. It comes down to the river, and there
is a good aoregge of fine coal. There are a great number of openigs
all over the property, which will give a good test of what the coal
is all over-the boundary. ‘

My price for this coal is from @50. to $65 per acre.

If you are interested, and went to sell it as an agent, will give
you 5% for a straight price of @50. , and for all over ebo. 10% on the
excess of #50. ' own

what we hai¢,e1ready, and what we have contracts on, we can
furnish from 4000 to 5000 acres. we can add to this, a lot more
boundary, if it should no necessary,in order to make the trade go,

This preperty lies on Peytone.Vreek, ded Creek, Upper and Lower
Chloe Creek, burning fork of Raccoon Creek Frazen creek and Raccoon
Creek, and front on the river, above Shelby station.

Will be glad to hear from you at once, find then you went to
have the praperty shown up. -

Herewith enclosed is letter from Mr. Frank E.

In canhection with the eXCGQtiCRS to the sale
of the property in this case, I beg to call your atten-
tion to Secs. 640 and 641, Montgomery's Manual of Fed. ..4

p. 243; 3 U. 8. Comp. Stats., 1916, See. 1640. I do not
know exactly what you have in mind as the basis for the ex-
ceptions to this sale, as, if this is all the law on the
subject, I doubt if the exceptions should he sustained for
the failure to sell the prOperty on a ecurt day. The con-

 October 14,1919
My dear Mr.Harkins,-

Your kind letter dated the and received and in
reply I feel sure that the trustees would be glad to sell our share
of the coal lands at the price named in my last letter on a basis
of part down, say $2500.00 and balance in five notes secured by a
mortgage. One note could be made out to each heir and in that way ‘
we could get a division of this property.

I would be willing to sell,my i/iQ interest for_the¢lump
sum of $1500.00,or if"y0u"should want to buy this interest,I would
take half cash, balance your note. This would give you a controlling
6/10 ths interest in the property.

I have not a list of the properties here but am writing my
brother to see if he can send me this list for you. As I remember
it most of the tracts lay on Prater Creek and the total area was
5,010 acres.

Sincerely yours, 1
