I had a conversation with C. C. Jeiger
in Ashland this morning and he said that his
attorney was going to insist on a trial of our
case at this term of court, but that the defense
was going to try and have it put off until next
court.

he also informei me that Judge Wheeler
was looking after our interests down there, and
that Wheeler was the one that was trying to have
it put off, having an interest on both sides.
1 would like to know whether this is the case or
not, as i would like to have you take a rersonal
interest in it, as it means cuite a little item
to me.

Gentlemen:

At the request of your Hr. Cox I take pleasure in
handing you herewith description of six thousand (6.000) acres
of coal property otned by the Harkigs Estate on Prater Creek.
Camp Branch and nrkansas Creek in oyd County. Kentucky.

Beg to advise that the coal is in en exceptionally
uniform block and is of Very high quality. There are to be
found on this property Elkhorn Number 1. 2, 4, and 5 seams
of coal, all of w ich seams of coal are being operated by pur-
ties who own the pro,erty joining this property. The Elkhorn
Number 1 seam occurs ab ut the level of the watershed at the
bottom of the hill .nd is from forty-two to forty-eight inches
in t ickness; this coal has no parting. This seam of coal is
oper-ted by the Dittsburg-Coal Company at Detsy Layne, Kentucky.
by the Peerless lehorn Coal Company at the same point and by
the Mud Creek Coal Company at harold, Aentucky. The Number 2
hlkhorn is Operated by the Wakenve Coal Company below Drift;
Kentucky. on BenVer Creek in this county. The humoers 4 and 5
seams are being operated by the Wakenva Coal Company at Ivel.
Kentucky. Number 4 seam has an average thickness of four feet
with three inches of bone parting and will cover about fifty-
two £52) per cent of the acreage. The Number 5 seam is seventy-
six 76) inches in heighth with about eight inches of parting.
This seam occurs ciose to the top of the hill and is found on
ubcut fifteen to twenty per cent of this acreage.

The harhins Estate will lease this coal on a royalty
basis of ten (10¢0 cents per net ton of two thousand (2,000)
pounds with a graduated scale of minimum royalties which me would
be willing to make very reasonable should you desire to embrrce
the whole of this property on one lease.
