attorneys, Cincinnati, frOm whom the claims comea,direct that
the action be brought in the Federal Court against yOu and
your Mother,seeking personal judgment and subjection of the
thirty-six shares of the capital stock of the Graham Coal & Min-
ina 00mpany. They singlefl yOu two out for the reason that ;ou
are Lee only ones liable on both notes,aud the efore the only
ones liable for a sufficient sum to give federal jurisdiction.

The affiant, George Music, says that he is a citizen
and resident of Betsy Layne, Floyd County, Kentucky; that he
is sixty (60) years of age; that he is acquainted with Samuel
Spradlin of Prestonsburg, Kentucky and has been acquainted
with him for at least forty-five (45) years; that he knew the
said Spradlin for a period of more than five (5) years prior
to the time of the Spanish American War and that prior to the

panish American War this affiant lived on Little Paint in
Floyd County, Kentucky, a distance of approximately four (4)
miles from Prestonsburg, Kentucky; that prior to the time of
the Spanish American War the said Samuel Spradlin was a

school teacher in the common schools of Floyd County, Kentucky
and taught county schools in the vicinity where this affiant
lived and by reason oft;his fact affiant was closely associap
ted with Samuel Spradlin prior to the time of the Spanish
American War and knows to his personal knowledge that the
said b'prnilin was a man of sound physique and good health, and
not effected with any disease prior to the time of the said
Spanish American War.

That this affiant and theeaaid Samuel 5pradlin was each
members of the same company and were first in camp at Lexington,
Kentucky; that during the time the company of which tris affiant
and said Spradlin were members was in camp at Lexington, nentucky
they were housed in tents without floors and without beds or
cots to sleep upon and were compelled to sleep upon straw spread
upon the bare ground and that during said time there were heavy
rains in Lexington and vicinity, and frequently the straw upon
which affiant and Spradlin each slept would be soaking wet in
the mornings; that the company of affiant and said bpradlin was
so housed for approximately a month before they were mustered
into the services and given equipment, and thereafter said
company was at Lexington for a period of more than two months
further, at which time said company was transferred to Camp
Shipp at Anniston, Alabama and reached there about theiLime of
the beginning of the rainy season} that a portion of the time
while at Camp bhipp the members 0 affiants company, inc uding
affiant and said Spradlin were compelled to sleep upon the bare
ground.

That as a result of this exposure the said bpradlin
developed rheumatism which seriously efiected his hands, shoul-
ders and knees, and at different times would be kept in the
tent and cared for by Sergeant G. J. Bolts, who was Top
Sergeant of said company and the said Spradlin was a Sergeant
under mid Boltz; that the said Boltz was a very old man without
much education and the said Spradlin kept the records of the
company for said Boltz and frequently affiant saw said Spradlin
working upon the books of the company late in the night using
two candles for light; that the said Spradlin while at Camp
§hipp developed trouble with his stomach and lost weight from
about one hundred and thenty-five (135) pounds to sheet one
hundredzand ten (110) pounds, and his eyes became disabled and
effected to a substantial extent whereby at times he was

 required to stay in a darkened tent for several days at a
time.
The affiant says that prior to the time he and the
said Dprudlin entered the Spanish American servicecat Lexington,
Kentucky the said Spradlin had not suffered with rheumatism
or stomach trouble or his eyes to the personal knowle:ge of
this affiant, and that the rheumatic condition, stomach trouble
and the affliction of his eyes each and all developed while the
said Dpradlin was in active service at Camp Shipp in the Spanish
American War.
' In addition to the disabilities hereinbeforc set out,
that affiant, at different times whilezat Camp Shipp, asked
the said °pradlin what was the matter with him at times when
he would appear to be exhausted and that at those times Spraclin
said to this a fiant that he had palpitaticn of the heart, which
was responsible in his judiment for his exhausted condition.
Affiant further says that he has at different times
since he and the said Dpraolin was mustered out of the Spanish
American War services seen the said Spradlin and in his judg—
ment the said Spradlin is totally and permanently disabled from
the performances ofany duty and that such disabilities which
he now has arose out of his active service in the line of duty
in the Spanish American War.

sixty-two years of age; that he is a graduate of the Louisville
Medical College of Louisville, Kentucky and has been a regular
licensed practicing physician for forty (40) years; th t he is
acquainted with Samuel spradlin of Prestonsburg, kentucky, and
has known the said Samuel Spradlin all of his life; that until
affiant withdrew:from active practice a few years ago, heuas the
regular family physician of the said Samuel Spradlin; th t the
said Samuel Spradlin is a veteran of the Spanish American War,
and received a discharge from active services in such war; that
within a short time after the discharge of the said Samuel
Spradlin and his return to Prestonsburg, this affiant treated
theesaid Spradlin for a period of approximately six (6) months
for rheumatic conditions and stomach trouble and that such
rheumatic conditions were of such£3everety that the said Spradlin
could not feed himself and had to be fed by a member of his
family, usually his wife; that in additionthercto these general
conditions so effected the eyesight of the said Sprudlin thmt
during said period of time he was required to be kept in a
semi-darkened room.

Affiant further says that the said Spradlin has from
time to time since that date consulted affiant and complained
of a continuation of the rheumatic conditions and stomach trouble,
and to this date complains Of the same; that in the judgment of
the affiant thessaid Spradlin is suffering at this date from a
disability which is permanently and totally disabling and that
such disability resulted and exists from diseases incurred by
him in the line of duty during active service in the Spanish
American War.

The a fiant, Dr. 0. T. Stephens, states that he
is a regular practitioner of medicine at Prestonsburg,
Kentucky, and that for the past three or four years has
been treating Samuel Spradlin affine city for heart disease,
known as Myocarditis, together with a nePVOus disease, Neuras-
thenia, gravis andailso chronic Gastritis; together with
chronic arthritis envolving the knees and shoulders, which
is moderately advanced. His condition since November 1931
has been such that he is totally and permanently disabled
from the performance of any part of his occupation.

Theziffiant says that in his opinion the conditi ns
above set out could havex esulted from the active military
service in the line of duty in the Spanish American War, and
that said bpradlin is now totally and permanently disabled
and will be so disabled continually from this date.
