bars can stay open late

again go out and shake their
fannies in public at 3 am. and
bar and club owners feel like
putting on their dancing shoes.
too.

The Lexington-Fayette Ur.
ban County Council decided
Tuesday to repeal a law de—
signed to prohibit dance clubs
from staying open past 1 am.

Scott Crosbie. an at-large
city council member, said the
ordinance is unconstitutional.

“It never should have
come before the council in the
first place.“ Crosbie said.
“There was little debate
among the council. It was a
matter of approving ordinary
business. We see 30 or 40 of
these each week. and routinely
passed it. Instead of addressing
the problem. we were making
bad law."

Crosbie said police fa-
vored the law to curb drug ac
tivity and disruptive crowds.

The reprieve may only be
temporary. The city is re
searching a similar law which
lacks the originals flaws. said
Susan Straub. Mayor Pam
Miller‘s spokeswoman.

“The ordinance passed has
unintended consequences. It
would impact businesses such
as bowling alleys and the Ken»
tucky Theatre. That was not
the intention." Straub said.

Establishments such as
Club 141. Kamakazies, Club
Chaos and Blue Max stay open

ter 1:30 am.

The law. for now. is still
on the books; the council will
vote to repeal it Jan. 17 and 24.
In the meantime the law will
not be enforced. The council
passed the law 26 days ago. one
week after the Lexington Area
Party Plan was passed

Several bar owners filed
an injunction to prevent its en-
forcement soon after.

The injunction. combined
with the law's short life span.
meant that the ordinance bare-
ly stopped after-hours revelry.

Some club owners under-
stand the city‘s desire for qui-
eter nights. “I‘m very pleased
with the decision. though
something has to be done.“
said Club 141 owner Mark Wil»
son. “The situation was getting
out of hand."

But they thought the law
was inappropriate. “They put

us all in bed together and cov—
ered us with one blanket." Wil-
son said. “There must be a bet
ter way."

Crosbie agreed. “There are
other means of correcting the
problems."

(.‘lub owners also thought
the ordinance would hurt.

“This would put me out of
business." Wilson said. "Sixty
to '70 percent of my income
would be lost.“

UK students had expressed
frustration with the ordi-
nance. “I don't agree with it."
said Kyle Hamsley. a biotech»
nology freshman. “It would
take away chances for minors
to go out at night."

Wilson also said late. alco-
hol-free hours promote safety.
"We give people an extra two
hours to sober up I want to
praise the council and police.
but there is a better way. In a
city this size. we can bridge
the gap.“

New law targets party houses

Just as students were be-
ginning their break. the Lex-
ington Area Party Plan was
passed into law.

Now residents throughout
Lexington will face harsher
consequences if cited for noise
disturbances.

If residents have at least
two complaints that require
police enforcement. a cap will
be placed on the property. This
cap would designate the prop‘
erty a “no party zone" for one
year. If the cap is broken and
residents have further com-
plaints, they may be fined up
to $500.

Some students. like Ryan
Applegate. a mechanical engi-
neering junior. say they will
continue to host parties. de-
spite the harsher conse-
quences.

“I think it gives campus
police too much power." he
said. “It's bad enough that UK
is a dry campus and now they
are trying to place restrictions
on students partying off of
campus."

he is cautious about having
even a few friends over be
cause of the possibility they
could somehow cause a distur-
bance.

“It will make me more ap-
prehensive in having even
small gatherings." he said.
“The exact definition of a par-
ty seems vague."

Brett Reese, a recent grad»
uate of plant and soil science.
agreed that the risk is too
great.

“It would make me ner»
vous to get caught.“ he said.
“It could be on my record
now."

The Urban County Coun—
cil passed the plan in Decem-
ber with a 13-2 vote. Jacques
Wiggington. 2nd district coun-
cil member. and George
Brown. lst district council-
man and a UK Physical Plant
administrator. were the two
dissenters.

Wigginton said he doesn't
foresee the party plan solving
the noise disturbances prob
lems and parties.

“I don't believe in passing
bad legislation." he said. "i
recognize the problem. but the
plan doesn‘t offer a solution."

Wigginton said students
should not be discouraged by
the council's decision. but
should continue to take an ac-
tive role in their civic respon-
sibilities.

The penalty
The Lexington-Fayette
Urban County Council
passed the Lexington Area
Party Plan on Dec. 13.
Here's how it will work:

- Properties with at least
two complaints requiring
police enforcement will
receive a cap on the build-
ing for one year.

- This cap would designate
the property as a "no
party zone."

campus and the largest capital
project in llK's history. It will

Limestone and Virginia Av-
enue across from the Kentucky

law and chair of the University
Senate Council. surfaced this
information. Wethinuton later
apologized.

BBSRB. which will extend
about the length of a football
field and is budgeted at $67.2
million. will provide space for
neuroscience. genetics and {lt'
nomics research and vaccine
development

man of the UK Board of
Trustees, said putting: the re
search center on the west side
of campus was a smart choice.

“This without a doubt is
the right decision." he said

The site will also allow ITK
to expand its campus. said l‘res-
ident Lee ’l‘odd. “This (the West
side) is the place to build it."

more buildings to be construct
ed in that area. there would
have been more acceptance of
the Limestone site,
