Please refer to your favor of may 27th,1916, with
enclosures referred to therein relative to complaint hereto-
fore made by J. 0. Day and his sister, maggie B. Swalley, a-
gainst our Company for alleged damage to real estate caused .
by a river change made necessary in the construction of a
part of our roadbed on the North Fork Extension.

Your letter was referred to Mr. Seargeant with the
request that he have his assistant engineer investigate tho-
roughly the complaints of Mr. Day and mrs. Swalley and, af-
ter the receipt of assistant engineer Byars' report of Sept.
2nd, transmitted through MI. Seargeant, all papers were sub-
mitted to Chief Engineer of Cnnstruction Williams with the
request that he favor us with his recommendations as to the
position the Company should take in the matter of an amica-
ble adjustment of Mrs. Swalley's claims for the value of right—
of-way taken through prOperty now owned by her, in which at
one time J. C. Day had an interest, and for preperty damage
brought about through the river change. hr. Williams' let-

I note it is his recommendation, unless the owner of the preper
i I ty is willing to accept $ 200 in full settlement of her claim
Wi’or property occupied and for‘thelarea affected by the wash,
that we contest any suit which may be brought against th‘er‘kail-
road Company by Mrs. Swalley, making the best defense possible.
Necessarily, in cases of this kind, we must depend largely on
the judgment of our engineers; hence, unless Mrs. Swalley can
be induced to settle both claims at not to exceed $200 in the
;aggregate, I think they should be declined. If you agree with
" me kindly pursue that course.

17th instant written to hr. Jesse horgen of Hazard? by 3.1. Day,
one of our local attorneys at Uhiteshurg, Kentucky. This
corresnondence, as you will observe, has reference to comolaints
heretofore made by J.C.Day and his sister, ﬂaggic h¢ Swalley,
against the Comoany for alleged damage to real estotc,ceused by
a river change made necessary in the construction of a next of
our reed bed on the extension. It is desirable that this maxter
be promotly handled so that litigation, if noeeihle, may be

Dear Sir:-

You no doubt re-call some correspondence we had, relative
to certain damages claimed by Jesse C. Day, to real property just
below Whitesburg, which was caused by the river change made by the
Company, in the construction of the Road bed, and we, at one time
wrote the Company about it, but the Company did not seem to under-
stand it, at the time the change was made, J.C.Day and his sister,
Maggie B. Swalley owned jointly the property, but recently, they
have divided the property by deeds of conveyance, and now Mrs.
Swalley owns the property where the river change was made, and
where the damage was done, and she has come to see me this morning
and wants to settle the matter and I told her 1 would write you and
you could take it up with the proper authorities.

The land taken has at one time, been surveyed out and staked off
but it has since that time out in more on the bank and it is Likely
it ought to be re-stsked off and see just what the Company would
want, or what it will need.

bince she has become the sole owner of the property, she
says she will be willing to take $500.00 for all the damage done and
will take care of the banks herself and I talked with Mr. Harvie
about this and he advised that I write you, so you can take it up

' With the proper parties and see what they desire to do and whether
or not they will consider a proposition of settlement, as she will
likely file a suit unless we can adjust it with her prety soon.
