Louisville & Nashville Railroad Company, and
Lexington & Eastern Railvay Company, Defendants.
This cause is submitted on certain motions and
demurrera interposed by tho defendants, some of which wero
fled at the November rules, 1914, and one other: have been
filed at tho presant torm, April 24th, 1915. fia take those
up in rogulur order.

1. Motion to Fill Blanks - There are a number of
blanks in the original psiition and it is so obvious that thaao
blanks should be filled that we do not tqkq time to argue the
point.

20 Motions to Exact - Thara are two motions to alacfi,
the first filed Novomber 2, 1914, and the sacond filed April
24th, 1915. Tho first motion points out what Booms to be a
manifes‘b incmsistnnoa in the pefiitionfigikxat which first
alleges in substance that there Was a place on dofandante road
whoro by custom or sufferanoe persons were in the habit of
boarding and alightlng from dafendanis’ trains, and than later
alleges thwt defendant were nagljgont in not providing a fixed
and certain plan» for persons to board and alight from their
trains. The contradiction betwoon the zwo positions taken seems
i0 us plainly apparent and if this be true, we submit that tho
motion to elect be ausfiainad.

The second motion to elect relatea two thraa matters
macifically mentioned in ,m motion, viz., (a) for plaintiff
to state definitely,by election, whethor by the use of tho

 charge that the accident complained of happened 22 tbastutjon
named or ONIY fiflfifi 931d station. Construing the pleading most
strongly against the pleader the allegation must be taken to
mean near rather than at (Davis’ Admr‘ Va 3 & 0 R Go. 75 SW 275)
but we prefer to give plaintiff an opportunity to declare himaolf.
(b) Whatever may be the ruling on the foregoing, we ask that
plaintiff now be required to elect between the statemont in the
petififiun that the aooidant happonod ”at or near Neon station”
and the stotemont in ohe amended petition that it happened “on
the ”Y' 33 £233", meaning thereby the settlement, neighborhood
or village of Noon instead of the railroad station bearing that
lane. It is plain to be seen that the fiwo places are not the
7 some but aro ontirely separate and gistinct. The accident
could not havo happened at both places. Hence the motion.
(6) In both tho original and amended petition reference is made
to w custom of boarding trains where tho qccidant happened and
to the boarding of trains at said point by onrmiseion of
dofendonts, fiwo things entirely differont and dioiinot. Her
ask that plaintiff bo required to say whether he proposes to
rely on a right to board the train by custom or upon a mere
permissive righfi, He incline to think that ho cannot mantoin
both. If not inconsistent or oontrodjctory, the existence of
a custom conferring rights would render permission unnecessary
and superfuhouo; on the other hand permission to do a thing implia
that the party granting permission might have withheld or refused
permission. Permission may express or implied; a custom is
never implied.
3. Motion to strike Out - This Motion relates to
two matters which are alleged in substantially the Same language
in both the original and the amended petition. Without repeat-
ing here the allegations in question, which are set out at
length in the motion itself, we content ourselves with saying
that, looking at plaintiff‘s petition, a! amended, as a whole,
it is wholly immetarial that defendants' emoloyee did not stop

 whether they did or did not furnish pr0per signals, or a place
certain for passengers to alight from or to board defendants”
train. Plaintiff's cause of action. if he has one, does not
in any way dfipend upon any or all of these things, They ara
wholly irrelevant and immaterial.

As to the other matters which we ask may be striken,
the motion is based primarily upon the ground that same is
incompetent to state or sustain a cause of action. There can
be, as we apprehend, no such thing as a customary boardlng
or leaving or trains by passengers or other persons and no such
thing as a permissive boarding or alighting from trains except
under certain prescribed and well defined conditionsc None
o1 which are alleged in the petition. From any such custom
or license as is relied upon or attempted to be relied upon
by plaintiff, he could have anxixhix derived no rights whatsoever
and his course of conduct on the occasion in question is to be
judged entirely independently of the existence of any such
customaryprsctice or supposed permission, express or implied.
The matters thus alleged are immaterial, incompetent and improper,
and therefore should be tllmlnated from the pleadings.

4. General demurrers to petition, to amended petition,
and to petition as amended . These pleadings speak for themselves.
Taking as true all the material facts alleged in both the original
petition and the amended petition, has the plaintiff stated a good
cause of action! Has he in other words, charged any actionable
negligence on the part of the defendants! We submit that he has
not and that a caraful examination of the pleadJngs will so show.

Without further elaboration, we ask that our several
motions and demurrers may be sustained, and the case thereon is
