I and you herewith Mr Landrums latter to me of the 6th inst
relative to the above styled case. It is set down for trial at
Hazard Ky on September 25th,ls13. Authority was given in this case
at $ 250.00 because that was the amount Hr Jcses Morgan said he
thought the case ought to be settled for under the circumstances.
‘s you will see from Mr Landrums letter to me the case can not be
settled for this amount or anything like that sum. I feel quite
afraidof this case myself and in my opinion if there is any liabilty
or even danger of our being held liable I think the case is worth at
least twiee $ 250.00 as a settling propopsition.Trcrc is no question .
in my mind but what this woman was qu‘te seriously injurcd a‘d for
‘ reasons stated to you in my letter in ”riting up this case I feel bery
much afraid that under the circumstances the Court will hold that we
owed some duty to this woman to have the crossing i: raiser bly safe
condition. I believe that it would be a good idea for you to take
this matter up further with Judge Wilson and Wootton and Enrcan.fiay
be the Jury will not give her much,it may not give her anything. our
trial attorneys seem to have their ”no on the Jury as this term of
the Court. They whipped out Faulkner before a Jury in the Cambell case
in which there had been scarcely any preparation at alland where there
was ample eVidence to have warranted the Jury in finding a pretty good
sized verdict against us. Still I thought I had better call your ‘

setti ed for anything like $250, the authority given. You love the
facts and you know-'vmat Dr. Morgan said as to the injuries sustained
by her- This Woman is going to testify to the effect that the has
nothing; like reocvered from the accident. She looks like a very"
delicate mman today. She claims that after she it, doV-n and then
gets to her feet that her head shine for several minutes and she is
going to show the injury how that is Just like she Showed me. She”
got to her feet and then staggered around for a fer: minutes and then
claimed that she Could stand up alright. Senaior Hogg has this
case. He told Morgan that it could not be settled for emytezing like
$500. In talking to the moman and her husband chart the case he
said that if we would pay $1000. he would acceg‘vtit but that he wouid
not accent a cent less~

In my opinion this Woman will get a large judgmeit against us-

rhe plaintiff, tallia Hoskins, states that the
defendant, Lexington 9 Eastern R ilv;o Co pony, is a
corporation, created and existing under the Laws of the
State of Kentucny, with power to sue and be sued, contract,
and be contracted with, and has for its business general
railroading, and known as com:on carrier.

Plaintiff states that the defenunnt owns and oper-
ates a line of railroad iron flexington, lentucky to ”sckson,
gentncky, and has been for the lost eighteen months, or more,
extending its lirc ofrailroad from Jackson, Lentucky, through
Lreathitt, Perry and Letcher Counties, Kentucky, up the Rorth
york filver, and Known as the "North York Extension" of its
line of rrilroad; th‘t the defendant now and was st the time
the injmméés hereinafter conploined of were received, onero—
ting and doing a genernl freight and pasSenger traffci on
that part of his railroad line from Jackson, Kentucky to
Hazard, hentucny; she states thnt the defendant has taken
and appropriated tor its road bed, for its line of railroad,

Fork of the Kentucky River a short distance below Bridge Xfi

which crossinL is and was recognized :nd maintteded by the
deiendant as a high way over its said railroad track at the
time the injuries hereinafter complained of were received,
and that said crossing is and was at said time used by the.
traveling public.
She states that on or alet 4th day of August,
1912, while traveling, she wasriding horsenback, she had fix
a right to and did go upon the high-way crossing aforesaid,
for the purpose of crossing some, -nd traveling “long the us—
ual line of travel; and olaintiff further avers end says the?”
at the time and place aforesaid (1) said crossing was con—
structed by the deiendant and was dangerous and improperly
constructed in (a) it was not properly and securely con-
structed by putting down plank or other suitablimaterial be-
tween end on each side of the xixx rails of said road up
to the level of the top of the rails as it should have
been, and was not thereby wdapted to the use made of it, an
' (b) in that it was constncted by wlacing small nquanti~
ties of earth and sand cetween the rails of said road, end
between the ties thereof, leaving said crossing in such
accumulate ,
condition that large quantities of water would Ehdudfif$§§-
the upper side of said road or crossing, so much so, that
said water would and did run and flow through and under said V
crossing, across the said railroad track, and along and
between the ties thereof, and thereby did cut and wash »
large cavities and openings under the surface if said cros-
' sing, and between the ties thereof,which openings and

, cavities was and could not be ascertained by the plaintiff
by ordinary or ronsnnable core and diligence, (c) and that
said crossing was not cuffioiently Constructed for safetey.
Che states that it was the duty of the defendant
to furnish a safe and secure crossing at amid time and place,
for plaintiff to travel over and across swid defindant's
railroad track, and it was the duty of the defendant to make
said crosxing at the tins and place aforesaid safe and se—
cure for plaintiff to travel over and on; but the defendant
failed, refused and n glected to provide or furnish a safe
and secure crossing at the time and place aforesaid for
plaintiff to travel on and over; :nd the defendant at the
time and place aforesaid failed, refused and neglected to
make said crossing safe and secure for travel, and in con~
sequence of said negligence of deigndant aforesaid plain-
tiif was injured as hereinafter set forth, and sufiered
all the injuries hereinafter mentioned as the direct result
of defendant‘s said no; igence; that at the time and place
aforesaid the plaintiff did not nd could not know of the in
secure and dangerous condition of the said crossing, but
was obliged to anddid rely upon de1endant to furnish a safe
and secure crossing.
Plaintiff states that on or about the 4th day of
gugust” 1912, at which time the aforesaid crossing was n
the unsafe and dangerous condition aforesaid, she was trov—
elinq on horse-back across deiendnnt's said railroad, on and
over the crossing aforesaid,and that while riding over and
across same the surface of said crossing suddenly gave away
and the feet of the mule which she Was riding dropped or broke
into one of the large openings or xoavities between theties
aforesaid, thereby throwing her violendy and suddenly off her
‘ said mule, her head, neck, face, back, body and arms falling

suddenly and vdolently upon the rails and ties of said
railroad track, thereby severely cutting her head and
severely mashing and brusing her head; face neck, body back,
and arms, injuring her internally, and seriously injuring
her mind; that her hfifoot at the time she was thrown from
her said mule Failed to release from the stirrup of her
saddle at which time her Said mule became excited and sudden—
ly ran, dragging her over the rails, and ties of said rail-
road track and earth, severely bruising her head, neck, f ce,
back,body, legs and arms, and sevcrnily injuring her mind;
and injuring her internally, from which injuries she be-
cmae unconscious and remained so for about Life hours ind he
been unconscious may times since, up to the present time;
and that all of the aforesaid injuries both physical and
mental are of a permanent nature, ;nd were received and
suffered by her by reason of, end as u direct result of the
negligence and carelessness of the defendant afqresaid.

She states that at the time and place aforesaid

‘ while exercising due care and diligence for hersufety she
was by reason or and as a direct result and consequence of
the aforesaid negligence of the defendant, and by reason of
the aforesaid defects in the aforesaid crossing thrown vio-
lently and suddenly from her mule aforesaid adn Was seriousw
ly :nd permanently injured nbothphysically and mentally as
aforesaid, end by direct result and consequence thereof be-
caae unconscious, sore, sick, and disabled and suffered great
mental anguish and physical pain, and that she, by reason
thereuf, was compelled to did expend large sums of money
for medical care and attendance to her damage in the sum of
$2,000.00. She states that by reason of the injuries afore —
said all of which are of a permanent nature, which were re-
ceived by her as a direct result of the carelessness and

negligence of the defendant as uforesmid, she has been
damaged in the sum of ;6,0U0.00.
VHEREFORE, she prays judgment for the sum of
