the Jones Davis Compa ny.These descriptions were made out by my Ass¥s
tant, Mr. B. F. Williams who is thoroughly familiar with their locat-
twons on the ground. Please send me two blue prints, one for my file
.x1 13' for our Attorneys at Hazard.
The plaintiffs) James Eversole, and Harrison Eversole claim that the
fence below construction station 1922 to station 1899, was destroyed
by the employees of the said Jones Davis Co.) part being used to keep
fires on the grade, and the other part carried to the shacks of the so
several employees, for fuel. Part of the said fence was probably used
by the employees for fires on the grade, but the greater part the
plaintiff Mr; James Eversole had hauled by Irwin Eversole, and depos-
in his orchard near his house. The rails destroyed by the Jones Davis
00mpany, wgéra very small part of the original fence, possibly 33;?
The fence above the Hoskins Tunnel consisting of the Right of Way Fence
and three cross fences, running up the hill at nearly right angles to
the Right of Way Fence; the plaintiff claimes was nearly destroyed by
the employees of the Jones Davis Company; carried away by them to their
shacks, and used for fuel. Counting all of the rails, and allowing that
the defendants employees destroyed all of them, there is 567 rails, at
two cents per rail would be $11.54.“

damages, of said Jones Davis Company, on account of rec? being thrown
from the out at that station , by blasting, during the construction of
of the rardbed, and covering the strip of land lying along side, and to
the right of the Right ofaWay , purchased from him by the Lexington and
Eastern Railroad CompanygiHe claims that this has destroyed a strip of
land that would have made a very desirable 'Iater Melon Patch'.

When urged by the Engineer that the strip of land before mentioned was

The strip of land contains 0.0C acres.

From construction staticn 1842450 to 1944 ,the plaintiff claims damages
from the defendant, account of a few rocks being thrown fromnportal cut

and to the left of the night of way purchased from him, by the Lexington
and Eastern Railég:§.These rocks he claims have damaged the land for the
purpose of which it is best adapted. The strip of land before menticrcd

The barn roof of the plaintiff, Mr. James Everxole, was broken through
in two places, by falling rocks, and a few boards were typn loose by
small rocks falling on the roof. These places were repaired by the
sub contractor.“ Mike Casey'.
The dwelling of the plaintiff, Mr. Harrison Eversole, was damaged by
falling rocks. The door to the east room was knocked off of its hinges
and several small holes were broken through the roof. Kr. Eversole
was asked to move, by the sub contractor, Eike Casey,and he Hike Casey
would pay the rent of another house, also for the inconvenience caused
by moving. Kr Eversole holds a due bill, against Mike Casey, for the ren
and inconvenience caused himself, by mowing. The Miae Casey outfit went
into the hands of a receiver.
The plaintiff, Mr. James Eversole, claims damages, against the Jones
Davis Company, on account of some small trees being cut on his property,
Mr. Eversole claims these trees were cut by the employees, of the Jones
Davis Company, for fuel, hammer and pick handles, and for tram ties.
There were gkkof these trees cut in the logging woods where there were
trees of the same size cut every day. There were 105 cut £3 separate
woods, where there is no absolute proof who cut them. This makes a
total of 170 trees cut on his property, claimed by him, to have been
cut by the employeees of the Jones Davis Company,
The Plaintiff claims damages on account of encroachment on his land,
made by a waste bank at the right of the Right of Way, at the east end
of the Hoskins Tunnelu'This land about 0.12 acres, would have been
paid for,according to the contract, made between the plaintiff and
Lexington and Eastern Railroad.

Tressler case is a personal injury case. M. Tressler case is an old
suit. We sent you cepies of these suits, but if have not received
them will send you another. This is also a personal injury case.
The S. S. Roberts case is to enforce a lien.

We have been noticed of the sitting of the Master Cone
missioner but have not been present. Plaintiffs have not joined the
other lien holders in their action as parties. Think they have not
completed any of their sittings as yet. Notice was executed on us

in their lien cases.
