This is an action to recover 10 acres of land on
Lost Creek which was purchased by the Lexington &
Eastern Ry. Co. in 1906 when it was preparing to comp
struct railroad to Hazard by the way of Lost Creek. Ehe

conveyedfa part of it to Smith in consideration of the
conveyance from amithato his farm which joined this
. tract for right of way. EOble's heirs claimed title
to the land and have sued for same together with value
of rent on same during the time Smith has had it in pos-
session. .
