I herewith return carbon copy of
a letter from W. A. McDowell, Manager, to you
in reference to 566 Goodloe Street.

Quite a number of years ago I pur-
chased for Mr. Todd the terminal property for
the L. & E. Rairmay from Nelson’s elevator to
a point Opposite Rose Street on Main Street.

I had nothing whatever to do with the collec-
tion of rents. I have a flnint recollection
of Mr. Fain, the real estate agent, in connec-
tion with one or more of the houses purchased;
I have not the slightest recollection of ever
authorizing him to collect rents for anybody. ’
my duties were entirely confined to first get—
ting options, then to examining titles and
closing up and paying for the property. As
soon as the deed was made to my. Todd from me
and my wife I turned everything over to Mr.Geo.
Copland, who represented the L.& E.Ry. Company.
I had no authority to authorize Mr. Fain to
collect rents and I am sure I did nOt do it
unless it was a temporary arrangement While
the property was held in my name; my settlement
with Mr. Copland and the deed to Mr. Todd con-
cluded everything. _
There has been such a lapse of time
that I could not say Whether Or not I made some
temporary arrangement with Fain, but I don't
' believe I ever did.

as soon as Mr. Shanklin returns home, I will talk to him about the
arrangements he had with Fain and see whether rain was justified
either in retaining rerts as he did or was without fault in allowing
the property to be Sold for taxes and bought in by his son.
It is not surprising/in View of the very large number of
lots bought by the I & B through Kr. Shanklin, :hen the acquiring
of new rights of way was in hand, that one of these little lots
should have been overlooked, and it is, therefore, easy to under—
stand how Hr. Copland right have regarded this lot as lying outside

Dear Sir:-

Several days ago Mr. W. A. Newman, Engineer, took up
with me relative to a piece of property located on Goodloe street.
The L. & E. Railroad has owned for years a two-story brick house
situated on the corner of Goodiloe street and the L.& E. tracks,
this piece of property having been rented for over twelve years
by a colored woman named Emeline Stevenson. Mr. Newman informed
me that we owned the piece of property adjoining the above two-
story brick house and that the rents were being collected by Mr.
A. J. Fain, and requested me to take up and find out what disposi—
tion had been made of the rents collected.

I took up with Mr. Fain and he advises that he has been
collecting rent on this piece of property for Mr. Shanklin, who
formerly owned the property, I advised Mr. Fain that the L. & E.
Railroad held a deed for this property and asked him if he was
willing to settle without legal proceedings. I also asked him if
he had turned the money collected OVer to Mr. Shanklin. He advised
me that as soon as he could straighten his books, he would be glad
to settle. He further that stated that he had not turned over to
Mr. Shanklin any money collected for this property. This seemed
a strange proceeding to me, as it has been customary with myself
and I know with all parties collecting rent to turn same over to
the owner of the property at the end of each week or month. I
asked Mr. Fain if it was not strange that he had not turned the
rent over to Mr. Shanklin, as he has evidently been collecting
for this piece about ten or twelve years, but since the L. & E.
purchased the property, he advised me that Mr. Shanklin told him
to collect the rent and hold same until further advised. He stated
during conversation that several years ago this piece of property
was sold for taxes and was purchased by his son, Elmore. I know
Mr. Fain very well, also his son, and while it may be true that
this property was bought in the name of his son at this sale, I do
not doubt but that AL J. Fain has been receiving the benefits of
this rent. It appears to me that even if this sale took place,
that taxes were allowed to accumulate in order that sale might be
made. I feel sure that if I Was collecting rent for a an: piece of
property for Mr. Shanklin with instructions to hold rent until
notified to the contrary, that I certainly would make reports and
pay taxes on the property. If you will allow me to make settle-
ment with this man, I would suggest that we look up and ascertain
amount of taxes yearly for this property fihfigthat the matter of
the sale be disregarded, other than having t e piece of property
transferred back to the L. & E. Railway, if that is necessary.

I would suggest that we ascertain if this piece of property is

included in the Tax List of the L. & E. RailWay. At various
times, I requested Mr. Copland to allow me to look up the deeds
for this piece of prOperty, as I felt sure that the way it was
situated, it belonged to this Company. Mr. Copland stated that
we had no interest in the property.
In accordance with instructions, received this morning,
I will begin collecting rent for this Company on this piece of
property on Monday, November 10th, 1913.
