The plaintiff, John Couch, states that he is
the father of David Couch, who is an infant, and that
the said David Couch is under twenty one years of age,
and over fourteen;yeors; that the said David Couch has
no statutory guardian, Curator or co: ittee in this
state, and that the plaintiff is a citizen and a resident
of Sorry County, Kentucky, and is solvent »nd sues as
next friend of Said David Couch. J

The plaintiff, John Couch, as next friend to
Zuvid Couch, states that the iexinyton E Eastern 13i1Way
Company is o corporation organized and existing under the
Laws of Kentucky, and that it is now engaged in building]
constructing and Operating m railroad line through Perry
County, and was engaged insmid tusiness on and before the
Cause of action hereinafter stated occurred. He states t
that the said Railroad Comoany is now building and users-
ting a riilroad called its "North Fork Extension, begin-
ning at Jackson,in Breathitt County, Kentucky, and exte‘d- ‘
ing through Jerry County, and into betcher County, Kentucky ;
and said Company now has o égent at Hazard, Kentucky.

fixing the grade of part of said railroad line, just below
the station of Yerkes in Jerry Bounty, montuoky; thut at
the timn said railroad Company by its agent, Jillinm Toore,
who one secti_n foremun, marking a gang of men on its road
bed at or near Yerkes, Kentucky, employed his son; E§fi§M§$§.

bed, together with several other employee. he states that
et the time the said Railroad Company employed his boy to
work upon the said road bed, that the boy was totally in-
experienced in railroad work, and without any experience
:hatever in the work which they put him to doing; that the
said foreman, William Coore, failed to instruct the boy in
the/work of handling these cars and pushing, shoveling and
loading material thereon that he um: re uired to do by said
Company, its agent, Yoore, or anyone else in the way and
manner for him to handles said ours, and that the work in vyyfl
