Jouett that we should take possession of the property and enclose
it under fence as soon as the present crOp has been removed, and
not rermit the parties now cultivating the pronerty to exercise

Dear Sir:-

I am in receipt of yours of the 9th signed by
Mr. Northcutt relative to the above, and last week was making an
investigation as to the status of this property.
7 A I am returning you herewith mr. Anderson's file
which will probably give you all of the information you desire,
except I would say that the case which was reversed by the Court
of Appeals is reported in 154 Ky. 34S and 157 S. W. 726. After
the return of this case we completed the pleadings but plaintiffs
did nothing,until finally at the September term, 1916, the case
was dismissed without prejudice, a copy of which order you will
find in the file.

The situation in regard to the possession of the
property is as follows: When we purchased the property Mr. W. P.
Hackett, Executor, was present, and it was agreed that hrs.
Hickerson, whowag ngw Mrs. Hobbs, might cultivate the property
as our tenant an Ah 1d the possession for us. She, also, was
given the right to remove the stable from the property when she
desired. and I think that has been done. The possession continued
in that way until they filed their suit. so I doubt whether we
could new claim that her possession was that of the company
so as to authorize us to institute a forceable detainer action.

I have talked with hr. Hackett and he remembers the
conditions clearly Just as I have stated them, but I believe if we
were to institute a foroeable detainer action the court would
hold that the suit which had been filed claimdng the ownership of
the property and the fraudulent transfer would be suffiCient to
defeat the forceable detainer action, as the one question involved
in such actions, as you will remember, is that of landlord and
tenant.

On the other hand, I had wanted to discuss with you
the advisability of the railroad going upon the property and tak-
ing possession,an¢ thus forcing Mrs. Hobbs and the heirs to file
suit in ejectment, but if this step is taken I think we should
wait until the corn or the crop which is now upon the land has
been taken off.

If neither of the above suggestions is carried out
we would then have to file suit in ejeotment, which would prac-
tically raise the same questions as were raised in the case which
was dismissed. When that case was dismissed it was practically
conceded by the attorneys for Tarpy that there was nothing to the
case for we had plead that if the deed was not sufficient to pass
title to us we should be refunded the amount which we paid for
that piece, which was $700.00, with interest from may llth, 1910,
as the Tarpys had been using the property since the sale and were
getting the benefit of same. When this additional pleading was
filed, I think the Tarpys investigated the property, and came to
the conclusion that they had received full value, and if they
were required to return the purchase price they would be the los-
ers. as it was doubtful whether they could sell the property for the
price which we had paid.

By reason of the three above mentioned possible pro-
cedures, I had been awaiting the return of mr. Wilson to discuss
the matter fully with him and determine just what steps should be
taken. I am inclined to the second propesition, viz., that we
wait until the crop has been removed then go upon the property
and take possession of same by fencing and let them sue. In a
land suit I always like to be the defendant and let the plain-
tiff recover upon the strength of his title.

I am sending you by this mail Mr. Anderson's file,
and will ask you to advise me what steps you desire taken in re-
gard to this matter.

I am in receipt of a letter from Mr. Donohue asking that

I return to him ”upt. Anderson's file relating to this matter, as the
present Superintendent, Mre Morrison, is calling for it. Mr. Donohue

‘ also sends a letter from the Chief Engineer of Construction, advising
that when he recently passed this property he noticed that it Was
under cultivation, and asking what steps have been taken to secure
legal possession of it. I see from the file that Mr. Wilson has sent
you Mr. Anderson's file 110977 on December 21, 1916, and I will be
glad if you will let me have this as promptly as possible and also I
advise what the present status of this matter is. mr. Williams is
anxious that the Company get possession of it, and if the necessary
steps for this purpose have not been taken, I will be obliged I
if you will see that they are as soon as possible. I cannot tell
from Mr. Wilson's file just how this matter was disposed of and
do not know what the steps were that you and he proposed taking.
