Dear Sir,

Referring to your letter of the 2nd xxxtx ult. relative to
suit of R. C. Napier Vs L a h R 3 Co. I find that Napier owns about
two miles of river front on the opposite side of the river from our
railroad near Hapfor, Ky., and he claims an emenee amount of damage.

5 He tells me that he not only claims that the river washed his

5 land but that in the blasting in construction of the railroad

t a large amount of rocks were thrown on his preperty. He says that

‘ his damage is increasing every day, etc. I talked to him and to

; his attorney, Joe Johnson of the firm of Hog: & Johnson, and find

I that the claim they present in no small one but that they expect to

secure a verdict for $1200. to $1500. This being the feet it is
certainly a oese for our engineers to handle. Hr. Napier says that
the engineers made a map about two years ago showing the damage but
that it now three times what it was at that time? They say that
Tolbert Holliday, while he was handling river wash claims for the
Company offered them $500., etc- It seems from their conversation
that I got into the matter at a very late date and I hardly think
that I am the proper party to prOperly work up the case. You know
Napier as he las been bringing suits every since the road was started
end you know that we are up against a herd man end with Hogs &
