culvert, the said defendants stored a large quantity of powder,
dynamite, dynamite oops and other explosives in o huilding Situated
. about two hundred yards from the place of business of this
plaintiff and that they also had adjoining this store-rooml
‘ where they kept the said explosives, a blocrsoith shop. They
state that on the ___ day of Porch, 1913, as aforesaid, the
defendants carelessly and negligently placed those explosives
in such oloSe proximity to plairtiffs’ place of businoss and by
their careless and negligent hardlin; of said explosives, cansed
some to be oxplodeo and that the force or shoe? ofl fror the said
explosion demolished the building in which the ploirtiffs were
m doing business and scattered their goods and stock of morohardise

and destroying and otherwise damagirg Said stock of goods; that
at the timcof the said oxplosion, the plaintiffs were carrying
a stock of goods awounting to about eight or tor thousand dollars
' in value; that some two or three thousand dollars2 worth of thcoe
goods were totally destroyed and large quantities of the rooaioder
damaged so that they are not now salable:
The plaintiffa state that throngh the careless, negligent
» and wilful ocnduotx of the said defendant, Louisville & Nashville
Railroad Company andits employee and agents iv placing said
explosives in Such close proximity to their building m above
stated and the careless, negligent way in which they handled the
said explosives in the place where they were stored, caused

They state that the said agents and employee of the
V defendant CCmpeny, late at night and on Sunday evening, the
‘ 9th day of March, 1913, were working ir the blacksmith shop
adjoiniNg the said explosives and in the eamehuilding ir which
the said explosives were efored and while they were at work
there, had a large fire in said shop and at the time Lhewauit
work, late at night or Sunday night, the night before the .
explosion, they carelessly left oeid fire or said shop ih such a V
way that it set fire to and burned the building in which said
explosiveo were stored, causing said explosion which resulted
in the injuries to the stOGk of goods of the plaintiffs as hereir
set out.
WHEREFORE, the plajhfiffe, A. D. Campbell & Son,
pray judgment agaiNSt the defendeni, Louisville & Nashville
Railroad Compexy and T. W. Smith for the sum of Five Thousand
Dollars in damages. They prey fOr their cost and apx all proper

' PETITION.

The Plaintiflf, A.D.Campbell, for his cause fif action herein,
states that the Louisiille & Nashville RailCompany is a
corpenetion, organized under the laws of the State of Kentucky
and authorized by its charter to contract and be contracted ‘
with, to sue and be sued to do any and all things that a natural
person can do; that its chief office and place of buisness
is at Louisville, Kentucky. I

He says that the Defendant, T,W.Smith, is a contB-
actor and an amploye of the said Louisville and Nashville
emploved
RailRoad Company and wasAby the svid defendant Railroad Comp—
any and at work near Yerkes, Kentucky during the dates here~
inafter set out, A

He states that on the 9th. day of March, 1913, said T.W.

' Smith was employed by the said Louisville & Nashville RailRoad
Company to do some construction work on its line of rail—road
which passes through Perry County; that on said day he
was employed and at work in constructinn a cuéaert over said
Forked Mouth Creek near Yerkes, in said County and State; that
while engaged in said Constructing work, the swid T.W.Smith
and the Louisville & Nashville Railhoad Company, stored a large
quantity of powder, dynamite, dynamite caps and other explosives
in a building erected by them War that purpose, near the residence
(about 100 yards) of this Plaintiff; that the agents and employees
of the said Company also erected a building, or operated a
black smith shop in a room adjoining the room in which the said

Asaid explosives were stored; that on the said 9th. day of
March, 1913, and at a time when an unusually lagge quantity
of explosives was stored in the building as above stated
. the said agents and employees of the Louisville & Nashville
‘ hailhoad Company, worked in said Black smith shop until late
at night on the said 9th. day of March, 1913, aid that during
the night, by their carelessness and negligence, the said
blacksmith shop or the building in which the explosives ,

were stored, was set4fire and said explosives exploded.
He states that the éohcussitn and the jar and sheek
from the said explosion, totally wrecked the residence in
which this plaintiff and his famih? at that time resided
and that this Plaintiff was thnown from his feet to the Floor
and severely bruised about the body and head and so injured —
that he was practically unconsiows for a considerable time
, thereafter: that for days and weeks thereafter, he was
unable to transact any buisness and scarsely knew anything
or was conscious during any of that time; that he was permanently A
injured both mentally and physically as a result of said
explosion and that hgyghffered and will continue to suffer
both mentally and physically; that he has neeer been able
since receiving said injuries, to transact his buisness as he
did before that time and that his ability to transact buisness ‘
has been impaired; that all of the foresoinq injuries were

directly by the carelessness and negligence of the defendant
Company, its employes and agents in storing the said explosives
near his said residence and in the negligent way in which
I they caused same to be exploded and by reason of the fore~
going facts, he has been damaged in the sum of FIVE THOUSAND
DOLLARS.

Louisville & Nashville RailRoad Comapny, and T.W.Smith,
the sum of FIVE THOUSAND DOLLARS in damages; for his cost and i
