I return herewith enclosures received with your favor
of July 9th relative to fatal injury to extra gang foreman Joe
Smith at Typo, Ky., while he was a trespasser on a bridge at that
point.

It seems to me that the investigation heretofore made
ought to be sufficient for our purpose particularly as the duty
of defending this case devolves upon the contractor. I note
that Engineer Poindexter's statement, made by him on June 9th,
states that he saw this man on the trestle and supposed he would
get out of the way. Assuming that there was nothing about this
man to indicate he was not in full possession of all his faculties
and that it was not impossible to get out of the way, the following
cases are in point. Reynold's Admr. v. L. & N. 148 Ky. 252; N. C
& St. L. Ry. Co. v. Downey's Admr. 119 Ky. 751; Goodman's Admr.

v. L. & E., 116 Ky. 900. It is quite likely you are familiar

to call your attention to them.
