In the case of Maranda Palmer vs. L. & N., your file in
which I received today, our friends, the Mason & Hanger people,
from a reading of the correspondence in the file, appear to
give down their milk very reluctantly, and it seems to me that
if possible we should attempt to defeat the claim for damages
1 to the well. I understand from Mr. L. B. Applegate, who was
resident Engineer in charge of the work at Mud Tunnel, that
all the wells in that neighborhood went dry that fall without
regard to their proximity to the work.

on them by the court. There is a lot of objectionable matter

Gentlemen:
Acknowledging yours of the 7th instant, in reference to
suit in Lee Circuit Court of Maranda ?almor V. L d E E Co., I have _
to any that according to my understanding the question of liability
as between the L d N E Co. and the Essen & hanger Co. was canvassed
. by correspondence time ago, and practically agreed upon. In other
words, according to the iniornntion at hand, the only claim which
the plaintiff has any hope of establishing is the claim for damage
due to blasting, for which damage th: Laoon i Hanger 09mpany is
confossodly r sponsiolc. I have no sort of fear that the plaintiff
will succeed in establishing her claim that her well was caused to
go dry oy the making or the out in question. The out having been
made in a proper and workoanlike manner, there can Ce no recovery
by the plaintiff for any incidental damage to her well. To entitle
her to recover, under any circumstances, she would have to show, at
all events, that the cut was made in a nexliaent and careless manner.
The contrary of this, we are, of course, prepared to establish.
The prewosition on behalf of the plaintiff, as set out in
Ar. hurst’s letter to an of October 47, 1915, (of which a cooy was
mrilod you) is based, as I understand it, on the assumption that
there was some damage done to plaintiff‘s property by the blasting
over tions,otc. oi the contractors and conscducnt liability therefor.
On a trial, I think it practically certain that there will be acme

recovery, just how much I cannot prodict,on this account and,
of course, the Mason & Hunger Company woulfl be liable for such
mnount, together with the costs heretofore accrued and horeaiter
accruing. So ior as the 3 i N R Co. is concerned, I feel no

for your Company. If a trial is bad at the apnrouchiug Hovember

Marande Palmer against the L. & N. Railroad Co. was one

Co. responsible for under the contract, in so far as the
