Will Gabbard Vs L 8c N and Clarence Wright

Here-with I enclose to you papers in connection with the above
styled case.

Gabbaézd is the one that lost his arm in Chenowee tunnel by
being struck by a train about two years ago - he has never brought
suit on that account.

At the time of the accident covered by the suit he was employed
as water boy and Gabbard's sole duty was to carry the water fer the
gang. The hand car was being brouv‘ht from up on Potter's Fork
which was" then under construction and the men on the car were going
to the station at Neon for some supplies to be used in connection
with the construction of the track on Potter's Fork. Foreman

\\“ Larkey was not on the car at the time of the accident but had just
gotten off. The hand car was run into the switch Gaming out of
\ Potter's Fork and deer; ailed. Clarence Wright who was a negro was
\ riding the brake on the car. He evidently failed to stop the car
soon enough.

Gabbard was only slightly injured and worked on six months

before losing a day. Dr. Cornelius who treated him is now in

statement of L. 5. Larkey made to C S Landrum at Neon, Ky., on the
27th day of April, 1915, in regard to injury to will Gabbard.
My n me is L. P. Larkey. I am Foreman for the L a N R R Co
at Neon, Ky. I was in charge of gang at Neon, Ky., Extra Gang
in June, 1914. Will Gabbard was my water boy. Gabbard had only
one arm. Gabbard was injured one morning right after six oclock.
We were coming from Storage Track on Potters Fork. My cars were
up there. We were coming to neon after some material for use up
there. Clarence Wr ght was along and I do not remember just who
the other three were. I got off of the hand car at first bridge
on Potters Fork and the hand car w.s going on down to the switch
to get on the main line. Clarence Wright was riding the brake of
the car or r ther he was supposed to be riding it as he was in the
quarter. When they got to the switch they ran through it and
knocked the car off of the track. It did not turn over. When the
car struck the ties he fell off. He was hurt in the head. There
was a place out in his head. He was not kn cked unconscious. He
went onto work that day. He worked six months and four days after
that for me. He worked every day. Did not lose a day that I was
up here. Dr. Cornelius treated this man a few hours after the
accident to this man. I did not take Gabbard to the doctor
esvecially. We had a negro that had his leg broken and when the
negro nxnkx1mxxhxxdsntar was treated by the doctor at my cars
he .iso treated Gabbard- Clarence Wright was a colored man and
one that was work ng on the track with me. Gabbard's duties did
not require of him any thing other than carrying the water- The
work that the gang was accomplishing at thw time ofthe accident was
laying steel up on Potter's Fork. !xxkxdxnmx Trains were not
