Replying to your favor of the 15th, case of W.
D. Haddix vs. L. & N., I am not advised with reference to
the damage to this man's farm but in view of the fact that
his land lies adjoining the land of John Haddix and immediate-
ly above, I douht if there is any liability whatever since
I can not see how water flowing through Big Branch could
afiect Haddix's land nor how the embanknent which was built
below his land could change the course of the stream in such
a way as to cause him damage. I suggest that you have the
engineers of the company look into this matter and make a
' report.
For your information I enclose a cepy of the
last order ent red in the case, from which you will observe
that the case will not stand for trial at the coming term
since this motion to quash has never been passed on by the
court. '

I am returning herewith entire file relative to the case '
of William D. Haddix Vs. the Louisville & Nashville Railroad Company.

I have obtained the names of the following parties whom
'Mr. Morgan, our local attorney at Hazard, thinks will testify on behalf of
the Railroad Company,

William Russell, (Adjoining property owner to Mr.
Haddix.)

I spent one day last week in Hazard trying to see these
parties and find out justwhat each one would testify to, if put on the wit-
ness stand. I was only able to see the Messrs. Davis, the other parties
being out of town. Some of them living as much as six miles distance from
Hazard. The Messrs. Davis will testify that the main channel of the stream
is where it has been for the past thirty years, and that in extreme high
water, the riverhas always flown over the area containing the .34 acres on
which Mr. Haddix sues to recover damages. Also that they do not miss any of
the trees along the river bank on Mr. Haddix's place and that they still not-
ice the stumps of trees on the side of the river next to the railroad, which
would indicate that very little material was wasted over the the bank by
the construction of the railroad. Mr. John Davis says that in his opinion
Mr. Haddix has not been damaged and that he thinks the testimony of the other
witnesses would be practically the same as his. He advises that most of
them have pushed freight boats up and down the river several years prior to
the completion of the North Fork Extension and that they are familiar with
the river and the river banks, along Mr. Haddix’s place.

‘ You; letter of October 5th, file 6.73689, relative to
the suit lately instituted on behalf 3: Wm. 9. Haddix. I re-
turn Mr. ‘-‘~‘ilson‘s letter with copy of the petition. I attach
hereto letter fr om Simer‘intendent Seargeant of November 4th,
together with hlziepr int referred to therein, from which you
will note that the damage to this property is insignificant
and there is a very great question if the same has been 3:: —
casioned by any acts of the Railroad Company.

This suit is similar to a great number of others which
have been ire tituted in the territory since the construction of
the North Fort: Extension of the Lexington 8: Eastern Railmfzy and
I think that we should undertake to litigate rather then to make

Dear Sir:-

Your letter October 6th file 1402 and returning enclousres
suit of Wm. D. Haddix seeking to re-cover $1100.00 for alleged damage

to trees, land, fencing, etc, on account construction of North Fork

Extention near the mouth of Big Branch.

The Asst. Engineer writes me on November 5rd. as follows:

"I attach ma$>showing relation of Wm. D. Haddix property
tothe railroad line on the North Fork Estension near Haddik, Ky., and
return papers from the Chief Engineer covering suit by Haddix for $1100.00
damage caused by construction 0 Extension. .

Haddix claims $200.00 worth of trees washed out, $800.00
in land damaged and $100.00 loss in fencing. There are two small places
Washed out on the river edge, both amounting to less than one-tenth
of an acre. One of these is opposite the mouth of Big Branch and the
other is alongside a branch through his own land. Both of these are just
places as can be found all along the bank of any river. No trees have
been washed out unless they were in the areas above mentioned.
