Louisville & Nashville Railroad Company, Defendant.

The plaintiff, George Sexton, states that the defendant, Louis-
ville & Hashville Railroad Company, is a corporation, organized, cre-
ated and existing under and by virtue of the laws of the State of
Kentucky, as such it has she power to sue ans be sued, to contract
and be contracted with, to plead and be interpleaded with in its

1 corporate name.

The plaintiff states that on the 3rd day of August, 1916 while
engaged in loading a car of lumber, as an employee of the Coeburn
Lumber Company, on the side track of the defenant's yard in Whites-
burg, Kentucjy, and while so engaged in loading said car of lumber
for shipment on defendant's road, which car had been placed there by
defendant for said purpose, and while working upon a platform extend—
ing into defendant's car, and while the plaintiff was so there en- I
gaged, the defendant, iys agents and employees in the control and
management of its train and cars, did with gross negligence and care»
lessness shove or thrown and push back its cars and train against
said car and platform, while plaintiff was loading, and did thereby
knock, push and throw plaintiff fhrough and off said platform and in-
jured him by breaking his arm, and caused him to sugfer great excruc-
iating paid and mental anguish, resulting in a permanent injury to
3j11aij.1tiff.

 The plaintiff states that he has suffered because of said injury
great and excruciating pain and mental anguish and has incurred med-
ical attention to the amount of 3 xiww-,-.-w, and loss of time a—
l-f‘Loun‘ting to :3 "- .e,........ ‘.;,.4»—.--«--4---a~."-"-l’ and that he “Tn-as been Unable to Per“
form manual labor, and said injyrt is permanent, that because of said
injury he has been damaged in the sum of Five Thousand Dollars.

Wherefore plaintiff prays Judgment against the defendant Louis-
ville a Nashville Railroad Company in the sum of Five Thousand Dol- '
lars and all his costs herein expended.
