Replying to your letter of Dec. lst relative to
the above styled case: I now hand you herewith capy of
the order of the Clay County Court appointing John A. Bar-

- ger administrator of the estate of James F. Asher, deceased.
There has been some delay in getting this information due
to failure of the clerk of the Clay County Court to answer
my inquiries. In your letter of October 9th you ask wheth-
er it was incumbent on the engineer to try out the auditory
nerves of Asher. In the first place, it is to be borne
in mind that Asher at the time of his fatal injury was a
trespasser and that the engineer operating the engine which
struck him was not required to exercise any degree of care
prior to the time that Asher's peril was actually discov—
ered. I do not have before me the investigation file in
this case, but I see from a coPy of my. Warfield's letter
of Sept. 15rd to you that he quotes my letter to him as
follows:

"In this case decedent was discovered by en—

gineer when train was quarter of a mile from him;
he was then either on track or along side of track.
Thinking he would get out of the way, the engineer
turned to look at his time card and when next his
attention was drawn to the man he was on the track
and only four car lengths from the engine. We do
not owe a duty of lookout at the place where the
accident occurred."

Taking this quotation as a basis for which the
facts are as set forth in the investigation, I am tho-
roughly convinced that these facts appearing and nothing
more, always bearing mn mind that this man Asher was ap-
parently in the full possession of his faculties and walk—
ing along the track in the same direction in which the
train was going, are wholly insufficient to show that
Asher's peril was actually discovered at that time in a
legal sense. Nor do I think I am without authority for
this proposition. In Willis' Admr. v. L&N. RR. 90.,
164 Ky. 125, it was held: "although an engineer may see
a person walking along the track in front of an engine
at a point so far distant that he is not in any imme-
diate danger his presence does not put upon the engin-
enr the duty of giving W A R N I N G of the approach
of the train or taking otheraction in the anticipation
of the fact that the traveler may not leave the track.
He may assume that the traveler may leave the track in
time to avoid injury". As authority for this propo-
sition the court cites Reynold's Admr. v. CNO&TPRRCO.,
148 Ky. 252, L&N. RR. Co. v. Hunt‘s Admr., 142 Ky. 778,

Murray v. Southern Ry. C0., 140 Ky. 455, L&N. RR. Co. v.
Wiser's Admr. 164 Ky. 25. The Reynolds case, supra, is,
I think, very much in point. In that case, which was
an action against the Railroad Company for the death of
Reynolds, the evidence showing that the engineer saw the
deceased from a point 1880 feet distant s i t t i n g
on the track, and the court there held that the engineer
had a right to presume that the person would get off of
the track before the train reached him and that there
was no obligation to check the train until from the cir—
cumstances a person of ordinary prudence would conclude
that the person sitting on the track was heedless or
unconscious of the approach of the train. In the Rey-
nolds case the court commented upon the fact that the mere
interventiaaof a distance of two hundred yards without
movement by Reynolds, no other fact appearing then Rey-
nolds‘ presence upon the track, was not sufficient to
apprise a person of ordinary prudence that Reynolds would
not get out of the way of the approaching train. It
was further held in that case that as under all of the
evidence every'effort was being made to stop the train,
at least as far as five hundred feet before it struck
Reynolds, ordinary prudence would not require one to be-
lieve from a greater distance that the man sitting on the
end of the track would not get out of the way or was un-
conscious of the train's approach. If this was true as

to a man sitting on the track, it seems to me that for
much stronger reasons the engineer of the train which
killed Asher was not required to anticipate at a distance
of a quarter of a mile from Asher that he was would not
leave the track, when as a matter of fact, he was walk-
ing along the track apparently in the full possession
of his faculties and when only a step would have put him
out of danger. As a matter of fact, the whistle was
sounded at this man when he was from thirty five to fifty
steps north of the engine and he at that time could have
saved himself but did not because of his total deafness.
The trouble in this case is exactly the same as that which
existed in the Murray case, supra, which was commented upon,
by the court, to-wit, the inability of Asher to hear and
head the warning.

statement of Lillie Asher the wife of James F.Asher deceased,waiving her_

. right to qualify as Administratrix of the estate of her said husband,and
asking that her father John A.Barger be appointed as Administrator afore-

It is therefore ordered by the Court that John A.Barger be and he
is hereby appointed administrator of the estate of James F.Asher deceased;
whereupon the said Barger being present in open court,accepted said appoin
ment and entered into and acknowledged Bond to the Commonwealth of Kentuck
in the penal sum of $200.0o,conditioned according to law,with J.C.Morgan
and A.G.Gilbert his sureties,which bond was accepted and approved by the
