I wrote to Williams P Ccdell under dds of January
51st as per cspy 3f letter attachei, an& I enclese their reply
of February 7th ststirf that they will take care of this liti—
gatisn. I suggest, t ercfsre, that this Company only enter

_ reply in the case making general denial 3f liability, yer-

mitting the etntractsrs is take care 2f the defense. We
have a bend under our centract rith Jilliems E Csflell on
which the Maryland Casualty Campany is surew. This band prs- '
vides, however, that the obligeticn shall remain in full fcrce
and effect far a period of One yeer after the late of the pay—
ment at final estimate under tle centract. The final esti—

. me;e was paid March 51, 1916, and therefsre the bond wculd ex~
pire am March 51’ 1917, if this suit had not been filed. It

ville & Nashville Railroad Company and Codell & Williams,
under which the party seeks to recover damages in the sum of
1400.00 for injury claimed to have been received while em-
‘ . ployed by the contractors incarrying out work covered by
their contract withthe Louisville & Nashville Railroad Compa—
ny dated the let of November, 1915, under the bond of whidi
contract your Company is surety, it having been executed by
you on the 29th day of November, 1915. .
This is to advise your Company that the Railroad'
Company looks for its protection against any judgment, costs_
or attorneys' fees in this came from the con'ractors or your
_ Company as surety under'mis bond. I have already notified Ft
the contractors of this case and they have advised me that they .
will take care of it but I am bringing it also to the attentith

Louisville & Nashville By. Company
& Codell & Williams Defendants.

The plaintiff states that the Louisville & Nashville
Railroad Company, is a corporation duly organized and existing
under and by virtue of the laws of the state of Kentucky, and

, engaged in the business of owning, controlling and operating a
railroad in the state of Kentucky and other states its chief
office and place of business is at Louisville, Kentucky, and
that part of its line of railroad extends through Perry County,

. Kentucky, that Codell a Williams is a firm or partnership com-
posed of J.C. Williams and Codell now engaged in the
construction work and grading for the defendant Railroad Company
at or near Typo, in Perry County, Ky. He states that On or before
the 10th day of February, 1916, the defendant railroad company
was engaged in putting in a siding at a station called Typo, in
Perry County, Kentucky it was excavating dirt and making a cut

, for the roadbed of said siding, that Codell & Williams were
employed to do said grading for said siding; that before the

' 10th day of Eeby., 1916, a short time Codell & Williams employed
this plaintiff to work on said grade as a laborer at 31.50 per day,
that the said Codell & Williams on said day directed plaintiff
to do the work of driving a mule, hauling dirt with a cart, that
was being excavated on said grading job, that in performing the
said work, the said Codell & Williams directed the plaintiff to
hitch up the mule to the cart and haul away the dirt thrown in
the cart, that the place where they were at work was very dan-
gerous and large soft earth holes around the place that they

directed him to work and in attempting to hitch the mule to the
cart the mule sank into the soft earth and got hung in some way ,
while the defendant had directed the plaintiff to work and fell
to the ground in some Way plaintiff's third finger on his left
hand got caught in the bridle reins or some portion of the gear-
ing on the mule and jerked his finger into and broke it, that
from said injury he has suffered great pain and mental anguish
and has been unable to work or use his hand in any way since said
time that he was injured, and that since that time his said finger
has deprived him entirely from earning money, that his finger is
permanently injured by reason of the bone being broken and he
has been damaged by reason of said injury in the sum of Four
Hundred Dollars ($400.00). '

Wherefore the plaintiff prays a judgment against the
Louisville & Nashville Railroad Company, and Codell a Williams,
J.C. Williams and J.P. Codell for the sum of Four Hundred Dol-
lars, ($400.00) and his coat and all proper relief herein ex-
pended.
