well as your letter of same date, with reference to claim of the
above named party, we have secured from the General Baggage Agent
of the Terminal Station in Birmingham the Declaration of Value
Certificate signed by D. W. Ryan, showing that 24 pieces of bag-

. gage which was checked from the Terminal Station in Birmingham
for A.G.S. Train No. 4, September 19th, 1916, to Fleming, was
valued at only $200.00.

As this Certificate was borrowed from the Tenninal Sta—
tion on pramise that it would be returned to than, will you kind-
ly arrange to see that it is returned to us immediately after it
has served your purpose? A

You will recall that on January 29th I forwarded you
docket report and three copies of the petition, but since that
time have heard nothing from you except acknowledgment of the
letter. Will you kindly send me information for use upon the
trial as the plaintiff will insist upon a trial at the term of

Court which begins March 5th. Plaintiff insisted on 213 trial
at the February term, but owing to the newness of the case the
Court continued the same on our motion.
Please refer to my letter of the 29th ult., and let

Enclosed I beg to hand you docket report and 3 copies
of the petition in the above styled suit, summons in which
was served on I. B. Fields , agent, on today. This is a suit
for $118.00 for lost baggage to wit: one trunk, shipped as
baggage on Sept. 19, 1916, from Birmingham, Ala. to Fleming,
Ky. via Q. & C. from Birmingham to Lexington and via L. & N.
from Lexington to Fleming.

Plaintiff alleges that he purchased a.$59109 party
ticket and checked 2? pieces of baggages and that baggage corre-
sponding to check No. 1014 was lost.

, Plaintiff states that of the 27 pieces of baggage that
were checked 26 pieces were received.

As I am not informed as to what the contract is, between
the carrier and the passenger on a 50 party ticket and as the
plaintiff has nothing to show, will you kindly advise me what
this contract is, and what is the limit of baggage liability.

I have always understood that on ordinary tickets baggage
liability was limited to $100.00. and I assume that this was
a valid stipulation in the contract.

LOUISVILLE & NASHVILLE
RAILROAD COMPANY, ---------------------~--DEFENDANT.
Plaintiff, G. W. Smith, says the defendant, Louisville &
Nashville Railroad Company, is corporation created and existing
under and by virtue of the laws of the State of Kentucky, and
is engaged in the business of a common carrier by railroad of
persons and things in said State and elsewhere and was such
corporation and so engaged at all times herein mentioned.
That on or about the 16th day of September, 1916, plaintiff
purchased of the Queen & Crescent Railroad Company, at Birmingham,
Alabama, a fifty party ticket from Birmingham, Alabama, to
' fleming, Kentucky, which said ticket entitled himself and forty-
nine other persons to passage over said rote and connecting lines
from said town of Birmingham to Fleming, Kentucky; and at the
same time plaintiff had checked 27 pieces of baggage, among which
was plaintiff's trunk, hereinafter more specifically referred to,
which the said Queen & Crescent Railroad Company accepted and
agreed to carry on said ticket from the same place to Fleming,
' Kentucky.

Plaintiff now says that said trunk was delivered in good
order to the said Q. & C. Railroad Company as above set out and
was carried by said railroad Company to the town of Lexington,

> Kentucky, where it was delivered to and accepted by the defendant,
Louisville, & Nashville Railroad Company, for transportation to
Fleming, Kentucky; that said trunk, together with the other

 bug age referred to Was delivered to and somepted by defendant
in good order for carriage under said ticket purchased by him
at Birmingham as aforesaid, and that plaintiff, himself, and
. others of his party rode on said ticket from Birmingham to Flem-
ing of which distance the route from Lexington, Kentucky, to r
' fileming, Kentucky, was over the defendant‘s line of railroad.
Plaintiff now says that i aediately uuon his arrival at
: Fleming, Kentucky, he called at defendant's Office and presented
all the checks given him at fiirmingham for said bag age, includ-
' ing his said trunk, but was inforned by defendant's agent at
Elening that no baggage could be found corresppnding to check
£1014; that all of said baggage except his Said trunk had been
delivered at defendant‘s st tion at 3d‘lexuing; that said trunk
Was not then, or at all, delivered to plaintiff although he at
that tins and at numerous times subsequent thereto called at
defendant's office at said Fleming station and demanded delivery
‘ of said trunk. rleintiff now s ys he is unable to say what
cheek number saic trunk Wes carried under except that he was
informed that no baggage could be found for check do. 1014 as
above stated and that all other baggage had been received and
corresponded to the check nunbers of same. He further says that
said trunk has not been delivered to bin or to any one on his
order, or at all.
Plaintiff now says that said trunk contiined personal prOp-
' erty and effects of pluintiff and his iniodiatelf family of the
value of $118.00, the particulars of which being more certainly
shown by the itemized statement of said articles filed herewith
as part hereof and larked ”Exhibit A" , for identity; that by
reason of the facts stated sane is a total loss to plaintiff
and that no part of said loss has been paid by the defendant,
or otnersise.

 WHEREFORE plaintiff asks for judgment against defendant
for the said sum of $118.00, for costs and all proper relief.
