Dear Sir:
Referring to letters exchanged, relative to suit of
Dr. Taylor Hurst vs the Lexington & Eastern Railway Company
and the Louisville & Nashville Railroad Company, under which
he is seeking to recover the balance due him under assignment
from the Mason & Hurst Company, together with interest on the
amount originally due those people.
I sent you copy of my letter of March 5th to Mr.
Peyton and attach hereto impression copy of his reply of March
8th, from which you will note that while Mr. Peyton cannot state
definitely that he did not promise Dr. Hurst that he would be
paid interest on the money due him, still he is strongly of
the opinion that he did not do so. If necessary, I think that
Mr. Peyton would be willing to give deposition in this case
as indicated in his letter.

attached letter from Chief Engineer of Construction
‘ Williams, together with a carbon GOpy of the latter's
letter to MT. John Howe,Peyton, President of the E.C.
& St.L., and Mr. Williams' file #1501.
It seems that the claim of Taylor Hurst,
the plaintiff in this case has heretofore had atten—
tion at your hands, and that both you and Messrs. Mor-
gan & Nuckols are entirely familiar with it. I feel
very sure that MI. Peyton will say, in reply to letter
Mr. Williams has written him, that he did not promise
Dr. Hurst that interest would be paid on the retained
I percentage, but will we be able to overcome the testi-

The plaintiff, Taylor hurst states that the defendant,
Louisville e Nashville Railroad Company, is a corporation created
and existing under the laws of the state of Kentucky, with power
to sue and be sued, to contract and be contracted with, and is
a railroad corporation and common carrier, doing business in the
state of Kentucky and elsewhere, and in the county of Perry, in
said state; and that the defendant, Lexington a Eastern Railway
Company is also a corporation, created and existing under the laws
of the state of jcntuchy, with pO”CI to sue and be sued, contract
and be contracted with, and doing a general railroadinz cusiness,
and is a common carrier and has a line of railroad in the state
of Lentucky, and in Perry gaunty; that the said line of railroad
in Berry County is common to both of said coroorations.

years 1910-11-12, constructed What is commonly known as the
North fork Extension of the defendant, Lexington w Eastern
Railway company, from dackson, sreathitt County, Kentucky, up

construction of said extension the said defendants employed a

the Perry Circuit Court. lhe plaintiff states that on the date of
said order the said defendants owed to the said mason & Hurst, as
above stated, over and above the aforesaid $5,900 order to the
First National Bank of Hazard, the full and just sum of $7,598.84,
and that by the acceptance of said order, the defendants agreed
and promised to pay this plaintiff the said sum of 37,598.84;
that said order was accepted by said defendants by writing thereon
on the said 29th day of June, 1912, and said order and its ac—
ceptance is filed as a part hereof, marked "A" for identificatiOn.
The plaintiff states that partly complying with their
agreement and promise to pay him the aforesaid sum of money, the
defendants have paid to him for his use the following sums of
, money upon said order and the acceptance thereof, to—Wit:

He states that the defendants have repeatedly refused
to pay him any further sums upon said debt than the credits above
named; that there were certain suits pending in the Perry Cir-
cuit Court and in the breathitt Circuit Uourt in favor of cer-
tain persons as plaintiffs against the said Jason & Hurst, and
also against the defendants herein, and on account of the penden—
cy of the said suits, they being undetermined at the time, the

defendants refused to pay the plaintiff any portion at all of the
aforesaid indebtedness, because the defendants Wished to be in-
demnified with the aforesaid sum of money in its hands against
the probable result of the said suits as against the said defend-
ant.

' The plaintiff states that all of the said suits in
which the defendants were garnished in which they were parties,
or in which there was any chance of liability against them, have
been settled in the Eerry Circuit Court add in the Dreathitt
Circuit Court, and in all other courts where pending except
the action of mentley a Fitzpatrick against Mason a Hurst, in
which there was J in controversy, and in the
action of nenry Potter against the said Mason w Hurst, in which
there was in controversy a , and in the action of
D.Y. Combs against mason a Hurst in which there was 3555.88
in controversy, and in the action of Sullivan machinery Company
against nason a Hurst in which there was 378.09 in controversy,
and in the action of Lee Jebb against «ason a Hurst, in which
there is in controversy, £111.50. All of said suits were insti-
tuted and are now pending in the Perry Circuit Court; that in
none of said suits are the defendants liable, nor can they be
made liable for any sum whatever therein, because they were all
and each of them instituted after the date of said order and
the acceptance thereof, except the action of Lee Webb against .
Mason a Hurst, in Which there is involved the sum of $111.50
and interest from the lots day of April, 1912, until paid and

The plaintiff states that the defendants prOmised and
agreed to pay him interest at the rate of 6% per annum upon the
V aforesaid indebtedness; that shortly after the acceptance of

said order by said defendants he tendered to the defendants a bond
to indemnify_them in any sum they might be required to pay by
reason of the afOresaid litigation, and they agreed to accept -
said bond and to pay him the aforesaid money; that the said bond
was solvent and good for at least $55,000, but that when he ten-
dered to them said bond, and after defendants had agreed to
accept same and pay him the said debt, the defendants thereupon
declined to accept said bond and pay him said money, but at that
time agreed and promised to pay him a legal rate of interest
upon all of said money in their hands; that this said agreement
was made by the defendants and the plaintiff on or about the

WHEREFORE, the plaintiff prays judgment against the
defendants for the sum of $7,598.84, and interest thereon at
the rate of 6% per annum from the 29th day of June,l912 until
paid, subject to the aforesaid credits named herein as of the
dates mentioned, respectively, and for costs and for all proper
