a " The plaintiff, John Riddle, for cause of action against
:9 )?Y the defendant the Louisville and Nashville Railroad Company, says
i C; that the defendant is a corporation organized and existing under
. the laws of the state of Kentucky, and owning and Operating a
railroad running through Perry County, Kentucky, and having the
power to sue and be sued; that on the _____ day of June, 1917,
O the plaintiff was the owner of a fine gray mare mule, well
broken to work, and which mule was on the public highway leading
' fnem the station at Viper down the river to Hamden and Hazard,
\%i and which road at that place near Viper, Ky., runs parallel with
§E the defendant's railroad, and between the ra.lroad and the river,
§Q and very near to the said railroad. While plaintiff's mule was
in that position on that highway and going toward the house and
¥§\§>\ barn of this plaintiff, the defendant's freight train was moving
' \ up the line of the defendant's railroad in the direction of
Viper, whereupon those of the defendant's servants in charge of
K said train, negligently and carelessly blew a long continuous
blast of the whistle of the engine on said train and so fright-
ened the plaintiff's mule as that it run dn to the track a very
considerable distance in front of said train, and he says that
thereupon the agents and servants in charge of the said train
carelessly and negligently ran the engine of the said train on,
over and against the said mule and utterly destroyed the same to
' the damage and loss of this plaintiff in the sum of Five Hundred
Dollars.

WHEREFORE, the plaintiff John Riddle, prays judgment
against the defendant the Louisville and Nashville Railroad
Cempany, for the loss of said mule and its destruction by the
defendant as afatesaid in the sum of Five Hundred Dollars, with
interest thereon from the first day of July, 1917, until paid,
and.his costs herein expended.

herein and that the statements of the foregoing petition are
true as he verily believes, except as to the amount of damage.
