       Minutes of the Meeting of the Executive Comimittee of the Board of
Trustees of the University of Kentucky, Friday, August 21, 1964.

       The Executive Committee of the Board of Trustees of the University
of Kentucky met in the Board Room of the Administration Building on Friday,
August 21, 1964, at 1:30 p. m. , Eastern Standard Time. Those present were:
Mr. Robert Hillenmeyer, Judge James A. Sutherland, Mr. Smith Broadbent, Jr.,
Dr. Hershell B. Murray; representing the administrative staff of the University
were President John W. Oswald and Mr. Robert Kerley, Vice President-Business
Affairs and Treasurer. Dr. Ralph J. Angelucci, chairman of the Executive
Committee was absent. Mr. Floyd Wright, a member of the Board of Trustees,
was a guest.

       A. Meeting Opened

       In the absence of Dr. Angelucci, chairman, Mr. Hillenmever presided.
Following roll call by Judge Sutherland and having determined a quorum was
present, Mr. Hillenmeyer called the meeting to order at 1:40 p. m. , Eastern
Standard Time.

       B. President's Report to the Trustees

       Copies of the President's report are made available to members of the
Board of Trustees and to the press. It calls attention to the many and varied
activities of the administrative staff, academic, research, and service personnel,
and the students in local, state, national, and international affairs. As this report
is presented once a month, either to the Executive Committee or to the Board of
Trustees, it enables the President to present a "birdseye view" of the teaching,
research, and service functions of the University.

       President Oswald called particular attention to the article in this report
relative to the necessity for more town housing for the record number of students
enrolling in the University this fall. Approximately 3700 to 3800 students must
find town housing accommodations. The press was asked to cooperate in this
matter by bringing the urgency to the attention of the public through their news
nmedia. After several questions by members of the press, they expressed their
willingness to aid the search by asking the public to list vacancies with the Town
Housing Office.

      Other items of interest related to the implementation of the program for
Senior Citizens, President Oswald's visit with President Lyndon B. Johnson, a
$97, 000 grant to the College of Education to conduct a study aimed at developing
improved procedures for providing in-service education for Eastern Kentucky
school administrators, and the 15th Annual Leadership Conference of the Kentucky
Education Association which met on the campus in August.

       C. Resolution on Ashland Community College Plans

       President Oswald told the Executive Committee that Mr. Robert Kerley,
Vice President-Business Affairs and Treasurer, had been in contact with the
people in Ashland relative to the possibility of the University constructing a new
building on land to be provided by the Ashland Board of Education. Mr. Kerley
commented that he had never seen a more sincere and earnest group working to
build a stronger community college in their city. President Oswald then pre-
sented the following recommendation:

Recommendation: that the following resolution be adopted by the Executive
Committee of the Board of Trustees of the University at its meeting on August 21,
1964:

            Whereas, the Board of Trustees of the University of Kentucky has
            established a University of Kentucky Community College System
            including a college at Ashland, Kentucky, and
            Whereas the increasing student enrollment and expanding program
            of offerings render the present facilities provided by the Ashland
            Board of Education for the Ashland Community College inadequate,
            and
            Whereas it may be possible for the Ashland Board of Education to
            provide to the Board of Trustees of the University of Kentucky
            43, 4 acres of land in the Avondale section of Ashland at no cost
            to the University for the purpose of constructing a new Ashland
            Community College, therefore be it

            Resolved that in the event the Ashland Board of Education is able
            to make available to the University of Kentucky the aforesaid land
            under conditions agreeable both to the Board of Trustees of the
            University of Kentucky and to the Ashland Board of Education the
            Board of Trustees assures the Board of Education they will make
            every effort to put the property to use through construction of a
            Community College as funds become available and that the Board
            of Trustees will proceed prior to December 31, 1965, to initiate
            land use studies and preliminary planning.

Background: The administration of the City of Ashland, its School Board, and
interested citizens are pursuing steps by which 43. 4 acres of land, a portion of
which is involved in an urban renewal program, may be acquired and made avail-
able to the Trustees. Before further efforts are applied the Ashland group has
expressed a desire for a statement from the Trustees indicating their interest in
the possibility and their intentions.

       In February, 1964. the Executive Committee meeting was held in Ashland
at the Community College and, therefore, the members were familiar with the

location of the property. On motion by Judge Sutherland, seconded by Dr. Murray,
the resolution on the Ashland Community College was adopted.

       D. Presentation of the "Blue Report"

       The "Blue Report" is mailed in advance of the meeting of the members of
the Executive Committee in order that they may acquaint themselves with the im-
portant but routine items for which approval or action is requested.



                RECOMMENDATIONS OF THE PRESIDENT

CONTRACTS AND/OR AGREEMENTS

I. Easement to Kentucky Utilities Company

Recommendation: that approval be given to the granting of an easement (Pole Line
Agreement) to the Kentucky Utilities Company for the construction and maintenance
of electric power lines for a distance of approximately 1550 feet over the
University's Somerset Community College property, and that the appropriate
officers of the University be authorized to execute the easement.

Background- The electric power lines which are to be constructed on the requested
easement are for the furnishing of electric current to the Community College at
Somerset, Kentucky. The easement is, therefore, necessary and Dr. Ellis F.
Hartford, Dean of the Community College System, has recommended that it be
granted.

2  Proposed Contract and Easement with Lexington Water Company

Recommendation: that approval be given to an agreement with the Lexington Water
Company for the const ruction and installation by the Water Company of an 8-inch
water main of approximately 1, 487 feet in length across part of Coldstream  Farm
for a lump sum payment of $4, 850. 00, that approval also be given for the granting
to the Lexington Water Company of an easement across part of Coldstream Farm
for the construction and maintenance of the said water main, and that the appro-
priate officers of the University be authorized to execute the agreement and to
inform the State officials, who have the responsibility of considering the granting
of the easement, of the approval of the easement by the University.

Background: This water main is needed for supplying an adequate source of water
to the University's new Dairy Center, and the proposed agreement with the Lexing-
ton Water Company for its construction, as well as the easement for its construction
and maintenance across Coldstream Farm, has been recommended by Dean
William A. Seav. The total cost of the water main covered by the proposed agree-
ment is estimated by the Water Company at $9, 700. 00, but because the terminal of




 










this main will be connected with another of its water matins, the Water Company
proposes to bear half of the estimated cost of construction.

This proposed agreement is similar to the agreement entered into between the Uni-
versity and the Lexington Water Company, dated July 27, 1962, under which the
Water Company constructed 4, 085 feet of a 12-inch water main across South Farm
(Waveland) for $19, 000. 00, the total cost of which was estimated by the Water
Company at twice that amount ($38, 000. 00).

The title to Coldstreani Farm being in the name of the Commonwealth of Kentucky
only, and not containing the clause "tfor the use and benefit of the University of
Kentucky", the University is not in a position to grant the easement needed for the
water main; however, the State officials who have the authority to grant the ease-
ment desire the recommendation of the University.

3. Basic Agreement with the United States Air Force

Recommendation: that the Basic Agreement with the United States Air Force,
being Agreement No. AF 49(643)-531, and dated as of September 4, 1964, be ap-
proved and that the appropriate officers of the University be authorized to execute
the agreement.

Background: This agreement, which has been submitted by the Air Force, incorpo-
rates the basic provisions of future Air Force contracts , and is designed to avoid
the necessity of negotiating separate contract terms covering the conditions that
are common to Air Force contracts each time a new contract is placed with the
Air Force, the basic provisions being incorporated in the new contracts by refer-
ence to the basic agreement. The above basic agreement replaces and supersedes
our present such agreement with the Air Force, which is Basic Agreement
No. AF 49(643)-530, dated September 4, 1963. It is not, however, retroactive,
and, therefore, will not affect any present contracts the University has with the Air
Force .

4. Cooperative Agreement for the Mapping of the Geology of Kentucky

Recommendation: that an agreement between the Geological Survey of the United
States Department of the Interior and the Kentucky Geological Surrey; University
of Kentucky, for the continuation of a program of mapping of the geology of
Kentucky during the fiscal year ending June 30, 1965, at a cost of $900,.000. 00,
which is to be borne equally by the two parties, be approved, and that the appropri-
ate officers of the University be authorized to execute the agreement.

Background: The Department of the Interior in cooperation with the Kentucky
Geological Survey has been engaged since 1958 in investigating and mapping the
geological formations in the state of Kentucky, and this agreement is for a con-
tinuation of this program. Dr-. WAllicc W. Hg an, Director of the Kentucky
Geological Survey and State Geologist, has given his written approval of the

agreement, and the state of Kentucky has made an appropriation in this year's
budget of $450, 000. 00 for paying the cost of the portion of the program that is to
be borne by the Kentucky Geological Survey.

5. Cooperative Agreement for the Investigation of Water Resources in Kentucky

Recommendation: that an agreement between the Geological Survey of the United
States Department of the Interior and the Kentucky Geological Survey; University
of Kentucky, for cooperation in making an investigation of the water resources of
the state of Kentucky, during the fiscal year ending June 30, 1965, whereby each
party contributes $158, 825.00 for the investigational work, be approved, and that
the appropriate officers of the University be authorized to execute the agreement.

Background: This agreement is for the continuation of a cooperative program of
water investigation in Kentucky which has been carried on by the Department of
the Interior and the Kentucky Geological Survey for more than ten years. The
source of the funds to be provided by the Kentucky Geological Survey for the
fiscal year ending June 30, 1965, in the amount of $158, 825.00 are: Budget ap-
propriation from the general fund of the state of Kentucky, $70, 000. 00; apprropri-
ation from a fund of the Department of Highways, $88, 125. 00; and a contribution
of $700. 00 by the Kentucky Utilities Company, which has been received, for sup-
port of the annual strearn-flow operations on Dix River. Dr. Wallace W. Hagan,
Director of the Kentucky Geological Survey and State Geologist, has given his
written approval of the agreement.

NEPOTISM RULE WAIVER

1. Recommendation: the continuation of the waiver granted for temporary employ-
ment of Philip Beals, the son of a professor in the College of Commerce.

Background:: It is recommended that Philip Beals be allowed to continue in the
role of a part-time teacher of beginning accounting. Mr. Beals will complete his
program for the MBA degree in December and it is not felt that his temporary
employment will violate the safeguards against nepotism intended by the Board of
Trustees in the Governing Regulations.

2. Recommendation: that the nepotism regulation be waived in order for Mrs.
Vivian MtacQuown to accept an appointment as Reference Librarian. She is the
wife of Professor William C. M\IacQuown, Department of Geology, in the College
of Arts and Sciences. Appointment would be from September 1, 1964 to June 30,
1965.

Background: There is an urgent necessity to fill the position of Reference
Librarian with a qualified person. Mrs. MacQuown's qualifications are superi-
or to those of any other prospect. The imminence of the new academic year
makes it extremely difficult for recruitment in such a short time.

Recommendation: that approval be given to the appointments and/or other changes
which require Board action and that the President's report relative to appoint-
ments and/or changes already approved by the administration be accepted.

Background: Approval of the Board of Trustees is required for all appointments
to positions with the rank of associate professor and above, to promotions, and
to the granting of tenure, and to salary changes above $12, 000 for non-academic
personnel and $15, 000 for academic personnel. All other appointments and/or
changes may be made by the President with reporting to the Board.

INJURIES REPORT

of on-the-job injuries to employees of the University as shown below with the
usual understanding that the University does not admit negligence nor set a
precedent by favorable action on these claims.

Background: The nature of the injury and the charges incurred are shown below.
The report covers injuries to 14 persons. Treatment was given at the Uni-
versity Hospital in 11 cases, with outside services required in 3 of the cases.
The total charges to be paid by the University amnount to $280. 84.
