University of Kentucky Board of Trustees Meeting Minutes - 1879, June 10

Board met - Messrs. Metcalfe, Bradford, Duvan and Breckinridge present.

The minutes of the meeting of May 13 were read, approved and the action taken
at the said meeting was ratified.

Upon the recommendation of the Faculty, the degree of Bachelor of Science is
hereby confirmed upon N. B. Hayes, C. S. Perry, H. M. Wright and C. G. Blakely.

The agreement made between J. P. Metcalfe, Chairman of this Board and W. T.
Withers, Chairman of the Executive Committee heretofore approved is now ordered to be
opened on this record and is as follows, viz.(specifically):
"The use of the farming and garden implements turned over to the Executive
Committee of the Agricultural and Mechanical College of Kentucky by the Executive
Committee of Kentucky University except as hereinafter stated is conceded by the latter
named committee of said Agricultural & Mechanical College. The use of such portions,
the chemical apparatus, museum, geological, anatomical, mineralogical and botanical
specimens as may be required and specified by the professors of chemistry and natural
history, for their use is also conceded to said college.
The boundary of the land heretofore selected for said Agricultural & Mechanical
College as described in the communication of President James K. Patterson on behalf of
the college to the Executive Committee of the said University, is changed as follows: the
right to the use of the sod pasture west of the Ashland Mansion on the Richmond pike is
waived and in time thereof the orchard field at Dearville estimated to contain six acres
including the house upon it, and the

field of about 14 acres lying east of said orchard is taken by said A & M College. It is
understood that no modification of the contact giving additional land to the college when
the number of its students shall exceed 100 is made, the Board of Visitors in their opinion
not having the power to make such modification.
The boundaries designated in said communication of said Patterson, as modified and
changed by the memorandum, are subject to survey to ascertain whether that be more or
less than six acres should either party require it. The Agricultural & Mechanical College
shall have a right of way from the garden to the Richmond pike through the front gate at
the Ashland Mansion; also a right of way as the gates now stand, through the Woods
pasture east of the 34 acre parcel in which the college buildings stand, and through the
sod pasture hereinbefore mentioned along the line of fence to the gate at the Ashland
yard, so as to connect with the right of way from the garden after Richmond pike. About
one acre of the garden enclosed back of and southwest of the machine shop, known as the
house garden of Ashland, is excepted from the garden reservation as made in said
Patterson' s communication. For the use of their houses and wagons and cart turned over
and the Agricultural & Mechanical College, it is agreed that in the event of my claim by
said College for additional land over the 100 acres assessment of additional students a
claim of forty dollars shall

be allowed to the University as a set off to that extent against said claim. No charge for
said use of said houses and implements to be made by the University if no claim for
additional land is hereafter made by said College. Professor Crandall may select for his
use any machinery he wishes to use for instruction in his classes prior to the 28th instant.
Witness the hands of the undersigned chairman of the Executive Committee of the
Kentucky University and Agricultural & Mechanical College.
