We believe all questions have now been settled in connection with`
the construction of Railroad Tracks required for our new mine at Bonham,
Ky. and you may consider this confirming order for You to do the following
work.
You are to do all of the grading, concrete work, track—lay1ng,
ballasting and such other work as we direct and to furnish such material
as we direct in connection with this project on the basis of actual cost
of work plus 10%.
This percentage will apply upon the labor and general expense in
connection with the work as well as any material that may be purchased
in connection with same, but does not apply to track material or steel
girdere, which we are to furnish.
You agree to furnish a competent Superintendent to take direct
charge of this work — also a competent clerk to take charge of the ac-
counts - the cost or same including traveling expenses, also traveling
expenses of members of your firm to be considered as part of the cost of
the work, but no salary is to be paid to any member of your firm, nor is
any proportion of your general office expense to be charged to this mork.
It is understood that rental of any equipment other than small
tools, etc. will be charged at the following net rates:
l Steam Shovel - — @600.00 per month.
B Dinky Engines- — 165.00 ” ” each
Cars — — 12.00 each per month, we understand
16 to 20 will be required.
Concrete Mixer — 125.00 per month - we understand it
may be more economical for you
to buy this mixer and then sell it
when the job is finlshed,rather
than pay stra1a‘t rental,1n which
event you will do so.

Bonham
You are to furnish all small tools for use in connection with the pro- -
secution of the work without charge other than ordinary replacement of
tools worn out on the work.
You are also to pay all labor in connection with the work, also
for all materials that you ¤urohase in connection with same and render
at the close of each month a net bill covering all outlay with the under-
standing that you are to be reimbursed for this net outlay on or before
the 15th of the following month. Final bill, including the percentage,
to be due and payable within fifteen days after satisfactory completion
of the job- In rendering bills you are to attach a certified copy of
your payroll as well as receipted bells covering all expenditures. We
are to have the privilege of auditing your books on this job at any
time, should we elect so to do,
Your rental charge on the above equipment it is understood will
date from bill of lacing to bill of lading, in other words, them the time
it is shipped to Bonham until it is shipped away fron Bonham. We also
understand this equipment is now on the job and that you will push this
work through to the earliest possible completion and that you expect to
complete your part of the work by March 15. We will very much appreciate
your efforts to do better if possible.
In accepting this order you agree that you will pay compensation
or cause such compensation to be insured to all employes or their legal
representatives, for injuries received or death occasioned in and about
work contracted to be done, wholly in accord with the laws of the Stew
of Kentucky as contained in an Act entitled, "Gompeneation for Accidental
Injuries or Death.”
