REMARKS: It will be noted above that the fire protection record has con-
tinued to improve in spite of man—power and transportation dif-
ficulties imposed by the war.
Wood is now classed as the Nation’s most critical raw material by
the War Production Board. We can't allow forest fires to slow up
production or destroy young growth. As logging in Kentucky's for—
ests continues at a war—accelerated rate, slash and debris pile up
to increase flammability and make the job of fire protection more
difficult. Therefore, the active cooperation of every timberland
owner is more important thaneever before. You can help protect
your own land by:
(1) Persuading your neighbors to list their lands for protection
under cooperative agreement; and
(2) Requiring your tenants and employees to obey the State and
Federal forest fire laws and observe common-sense fire pre-
vention rules; and
(3) Paying your fire protection fee promptly. I
A statement of the number of fires and area burned during the past
year on the land you list for protection will be furnished on re-
quest.

Since writing our latter of August 27 and confirming my
telephone conversation with you thin morning, I wish to advise that
Mr. J. H. Mitchell end the local Progressives have changed their
‘ minds about working on Labor Day. Th y any that a large num or of
m n are going to lay off anyway if we do try to operate. The rest
of the mines in H rlan County will be idle and since it is a time
and one-half holiday, I believe that we will be better off to be
idle on Labor Dey. There will bo o lot of celebrations at the various
mines throughout the County and we will be idle.

Referring to your letter of September hth attaching
copies of letters by George F. ward of ugust 29 and jO, we
have read them over carefully and note what he has to say,
and we note the question you ask with regard to the position
our company is taking in this matter.
I would report that the company is taking the posi-
tion that we m st comply with the provisions in the labor con-
tract at the separate operations with respect to this point,
and you will note on the eighth page of your contract under
Item (7) -q¤¤t1¤e»
"For the purpose of determining the sixth dey of work
within the regularly scheduled uork•week, absences for the
following reasons shall be considered as hours worked:
"{a) The holidays designated in Io. 5 with the ex-
ception of xpril 1."
and other absences listed as (b), (0), (d), and (e).
You will note that tile cans that you have six holi-
days which when not worked are to be counted as days worked for
the purpose of detenmining the sixth day of work. he understand
from comparing with a copy of United Eine workers contract, they
do not have this provision in their contract. Apparently we were
iuveigled into writing 92bO into our contract and hence we are
where we are right now. This is a point that ought to be kept in
mind, I believe, in the writing of future contracts, and since
92hO has been revoked, it ought to be left out of future contracts.
Please keep it in mind.

with refereucc to the revocation of Executive Order

secutive dey of work in auf workweek or in computing
the hours worked ir any workweek,
Hr. Hose has written Mr. Galbreeth under
· date of September 7th with regard to this matte? ir
wtich he cells attewtion to our contract which pro-
vides that absences for certain holidays [including
Labor Day) shall he considered as worked for the pur-
pose of determinirg the eixth day of work. Under this
provision of the contract it will be necessary that we
oowrt Labor Day as a dey worked for the purpose of
computing the sixth day.
