TO ALL MEMBERS-
AND NON -MENlBERS:
There is enclosed herewith copy of a contract between the Harlan County
Coal Operators' Association and the United Mine Workers of America, which
contract was signed on August 18, 1958, and is to become effective on
September l, IQBB. This contract was negotiated for an on behalf of the
membership of the Association and therefore needs no individ al signatures
of the producers. The contract will apply to the operation of any non-
member provided that Company affiliates with the Association.
It seems far preferable for any non—member who expects to operate under a
contract to come into the Association and thus avail itself of the support
of the Association on all matters arising under the contract. The United `
Mine Workers are now presenting a solid front and there is no alternative
for the Operators except to present a solid front for the successful carrying
out of the contract. The Association can be of material help to all pro-
ducers in the execution of the contract.
Aside from that, the industry is constantly facing threats of freight rate
cases and the protection of present rates; the problem of se king new
business, matters of State and Federal legislation and taxes. The Associa-
tion has available a Safety Department that is capable of handling most any
situation or condition that might arise. The Operators can hardly do with-
out any of this service because if it had to be done individually it would
be prohibitive. ALL producers should therefore support the Association and
the burden should not be placed upon the FEW.
Tc all NON—MEMBERS a cordial invitation is extended to become members of
the ;ssociation to the end that the Industry may best be served.
As soon as it can be done, thc contract will be printed in pamphlet form,
and you will be fu nished as many copies as desired. And very shortly we
will be called upon to advise the Union Officials the names of the Companies
whe nxnect to accept and abide by this contract. Therefore, it will be
appreciated if you will let me know at your earliest convenience whether you
expect to work under this contract or will make your own contract.
There is also enclosed a Me orandum which speaks for itself and it is
su§$ested that this not be placed on the bulletin board, but merely used
to explain the situation to your men.

HARLAN DISTRICT AGREEMENT
This agreement mace and entered into between the Harlan County Coal Oper-
ators° Association, a voluntary association of coal operators, operating
coal properties in Harlan County, Kentucky, party of the first part, and
District No. IQ of the United Mine Workers of America, party of the seond
part.
WITNESSETH:
First. The Appalachian agreement concluded in the City of New York on
April 2, l957, is hereby made a part of the agreement between
the Harlan County Coal Operators' Association and the United Mine Workers
of America, District No. l9, except as herein modified.
Second. The parties hereto further covenant and agree as follows:
That this contract is for the exclusive joint use and benefit of the con-
tracting parties as heretofore defined and set forth in this agreement.
It is understood and agreed by and between the parties hereto that if the
United Mine Workers of America negotiate a wage agreement covering variations
in working conditions with any other person, company, association or dis-
tricts on a basis more favorable to .such other person, company, association
or districts than the basis of this present wage agreement, then in that
event the basis of this present wage agreement shall be modified so that the
Harlan County Coal Operators' Association and its members shall receive all
the benefits of such more favorable wage agreement unless such agreement has
been approved by the Harlan County Coal Operators' Association.
MAXIMUM HOURS AND WORKING-TIME. o
Seven (7) hours labor shall constitute a days' work. The seven hour day
means seven hours worked in the mines at the usual working places for all
classes of labor exclusive of the lunch period, whether they be paid by
the day or be paid on the tonnage basis; except in cases of accident
_ which temporarily necessitates longer hours for those mine workers re-
‘ quired on account thereof; and also excepting that number of mine workers
in each mine whose daily work includes the handling of man trips and those
the are required to remain on duty while men are entering and leaving the
ri;;.
OVERTIME
i,rL by mine workers paid by the hour or day in excess of seven (7) hours in one
hav or thirty-five hours in any one week shall be paid for at the rate of
tide and one half with the following exceptions:
*nployees engaged at power houses, sub-stations and pumps operating continuously
for twenty-four (24) hours daily are especially exempted from the seven (7)
leur day and the time and half provisions. Special exemptions for individual
employees other; than those named above when twenty—four hours continuous
operation daily is required are subject to arrangement between mine manage-
ment and District officers without time and half for overtime. Employees
so especially exempted are limited to eight (8) hours per day and forty (40)
hours per week and time and one half for the time worked in excess thereof.
The seven (7) hour day, five day WEE! (thirty-five hour week) as provided
in the agreement shall prevail.
The following classes of mine workers are excepted from the foregoing
provisions as to the maximum hours of work.
All mine workers engaged in the transportation of men and coal shall work
the additional time necessary to handle man trips and all coal in transit
and shall be paid the regular hourly rate for the first seven (7) hours
and time and one half for all overtime.

 Outside employees engaged in the dumping, handling and preoiration of coal
and the nrnufacture of coke shall work the additional time necessary not to
exceed thirty@0) minutes to dump and prepare the coal delivered to the
tipplo each shift and ,cemplete the usual duties incidental to the operation
of coke ovens and shall be paid the regular hourly rates for the first seven (7)
hcurs and time and one half for overtime net to exceed thirty (30) minutes
hereinbefore stated.
When day men go into the mine in the morning they shall be entitled to two (2)
hours payohhether or not the mine works the full two hours, but after the first
two hours the umn shall be paid for every hour thereafter by the hour for each
hour forked or fractional part thereof. If for any reason the regular routine
work cannot be furnished inside day men the employer may furnish other than the
regular work.
Drivers shall take their mules to and from the stables and the time required in
so doing shall not include any part of the days work, their work beginning when
they reach the change at which they receive empty cars but in no case shall
the driver's time be docked while he is waiting for such cars at the point
named. The method at present existing covering the harnessing and un—harnessing
of mules shall be continued throughout the life of this agreement.
Motormen and trip rid rs shall be at the passway where they receive the cars
at starting time. The time required to take motors to the passway at starting
time and the departing from the same at quitting time shall not be regarded as
a part of the days labor, their time beginning when they reach the change or
parting at which they receive cars but in no case shall their time be docked
while waiting for crrs at the point named.
HOLIDAYS
The following holidays are recognized: New Years Day, April lst. July 4th,
Labor Dey, Armistice Day, Thanksgiving Day and Christmas Day. These holidays
shall not deprive the operators of the right to secure the maximum number of
work hours per week as provided in the Appalachian Agreement.
CLEANING AND PREPATATION OF COAL
It is the purpose of both mine workers and operators to promote the loading of
and payment for clean and merchantable coal and the mine workers, the mine
committee and the officers of the United Mine Workers of America pledge thon—`
selves to cooperate with the operators in the production of merchantable coal.
If a cor contains an unreasonable amount of impurities the mine worker or mine
workers so offending shall be subject, on the first offense to warning and
docking; and for the second offense in any thirty day period to two days sus·
pension and dockage, and for the third offense in any thirty day period to
deckepe and discharge; provided in malicious and aggravated cases the mine
